Three Kenyans - a husband, wife and their daughter - were charged with criminal mistreatment on Friday in Puyallup, Washington after a 95-year-old woman fell inside an adult family home they own.
Prosecutors say the woman, Betty Torrey, feel inside the home in November and died in the hospital 11 days later. Puyallup police say video footage shows Torrey fell and cried for help and caregivers responded, but that they left her on the floor unattended for several hours until morning when someone called 911.
Charging documents have identified the three caregivers as Patrick Cubi Mbiri, his wife Lilian Wambui Cubi, and their daughter Santana Wangui Cubi, according to Patch.com. The incident happened at Able Care, a group home that is owned by the family.
Detectives say from the video footage, Torrey fell at 4am on November 13th, and that Lilian was seen entering the room and scolding her to get back to bed. Torrey asked for help again and Lilian and Santana responded to the call. A few minutes later, prosecutors say Torrey called for help yet again and fell out of bed, at which point Patrick entered the room “and slapped Torrey's hand as she was grabbing at the curtains, trying to get up. Prosecutors said Mbiri did not attempt to help, despite repeated requests for a doctor,” according to Patch.com.
Prosecutors say Torrey, who suffered dementia, said her leg was broken and she needed to see a doctor, but that her request was ignored. It was not until 7am that paramedics were called to help get her to bed, but that the defendants did not mention Torrey had fallen out of bed, instead saying she has a light “assisted fall.”
“The co-defendants did not mention that she had fallen out of bed at 4:30 a.m. and instead reported that she had a light assisted fall (which is contradicted by the video footage)… At the time, likely due to dementia — Torrey did not indicate any concerns to the EMTs that her leg was broken — even though she repeated(ly) verbalized that a few hours earlier,” ” the probable cause statement said.
At a cardiologist appointment later that day, the doctor noticed Torrey had a swollen leg and unable to bear any weight on it. She was admitted to Good Samaritan Hospital with a complex femur fracture and died 11 days later due to complications from the injury.
Prosecutors say Torrey’s fall was only discovered after Torrey’s granddaughter learned from Torrey’s roommate at the group home informed her that Torrey had fallen. Shen then reviewed the video footage and called police.
Patrick, Lillian and Santana have all been charged with second-degree criminal mistreatment in Pierce County Superior Court. Patrick faces an additional charge of fourth-degree assault. Pierce County Superior Court Commissioner Craig Adams ordered them each held in lieu of $75,000 bail. Lillian was said to be out of the country last week, and authorities said they would seek a warrant for her arrest.

Yes you are right
Yoh! Why did they forget to destroy the camera footage. Eeish. Now all these Americans who feel guilty for not caring for their own parents will be out for blood. The woman was 95 and kept throwing herself out of bed. If the old lady family feels so offended, why didn't they live with her? And don't tell me "they paid"...not to be woken up 4x
I support my Kenyan people. Be strong!
Really? Why did they not destroy the video footage??? That’s how low we’ve become, importing our corruption mindset to “majuu”. You should be ashamed of yourself but maybe that will never happen. You are actually trying to justify this by saying “ why didn’t their children take care of her Instead”????
Useless!
@ Common sense, you were doing just fine till your last statement... In all fairness, if the children took care of their mother as in this case,Mr cubi would not have his business. See its built on inability of children taking care of parents in old age...or sickly. Those who read Mwakilishi will note that this is not the first time a Kenyan health worker has been caught on camera abusing apataient.Well, folks, just be proffessional. That's what you are getting paid for.Or get out of this industry. How will you feel if your parent was treated like that???
Yes cameras have become real good partners in the prosecution of cases.
These (Kenyans) are good people. They kept coming Everytime she yelled. Those of you familiar with mental illness surely know how challenging it can be. The reason they went back; perhaps she was a violent patient; most are. They bite, kick, spit etc. I have only had the white folks version (of course designed to make black's look brutal et al) My Kenyans too must present their side. Support your own. The other version of story needed.
@Seneca, that is part of the job. When you go for training you are taught that some residents need 24/7 supervision on 1-on-1. You can not get a license without taking those training and pass. When wanted to save money by not providing this cucu 1-on-1 care.
Shame on your answer, mentally ill should still be managed without abuse. I am a psychiatric practitioner, and none of my patient get such abuses, I work in a real acute unit, do not just excuse such animosity. It's shame on them!
What is a psychiatric practitioner? You are a doctor or not. Or a nurse. Or a caretaker i.e CNA. Kufanya kazi kwa weenda...don't be ashamed. Most of us walked that path.
I am a director of clinical services in a hospital, was a doctor in Kenya, then a nurse in USA before my current position if that makes you feel better. I am not ashamed, I have a six digit pay and I am happy with what I do. I respect my clients, and love my job. Love KENYA, & USA. Respect is key!
Ati corrupt? It is called looking out for yourself. Every race has to!! You must know nothing about this great country the USA. What do you say about the US expat who knocked down someone's son to death in London and is out here hiding in the US, and the US will not return her to face Justice? It is a tough world. Defend your own. When at home, I will do per tribal rules. Out here,I will fight for black/Kenyan even if they be guilty as sin, someone MUST have misled them. I was once soft, then I was blunted. Now I only listen to Justice and objectivity. No feelings. Read Careyrou's book on the deceit in Silicon Valley to know how this shiet goes down. You my fellow Negroes will forever lag behind with your feelings. If she was a good polite grandma, why was she shipped off to live with strangers? This woman was 95 and had dementia! These people did not drop her down. And she looks like she was a trouble maker or even aggressive. I have seen those! Worse if they are racist. True, they are sick, but at times you do not enable their bad behaviour but ignore them. My countrymen are not psychics to know her hip was broken. Eeeish! It was an accident, period. Negroes, support your own.
@Senaca, like you say, this must have been a very difficult situation for our dear Kenyans. They were obviously very ill equipped and overwhelmed to handle this situation to make appropriate and timely intervention. I do not think they are bad people, or uncompassionate but they needed to have educated themselves to handle such a situation. Fact is, this elderly lady was a vulnerable adult and despite all the behavior described they should have handled this situation better. I do hope the Cubis and other Kenyans can learn from this. Before you envision big bucks envision this situation.
I think you are sinful like the devil himself you cannot support the such an obvious evil act like that
The Camera is not Kept there for you to see it, Ok?
The client was on the floor for a couple of hours and at some point got slapped by your “Kenyan People” I bet you also support your Kenyan people being beaten like warthogs by the Chinese people.
@Seneca, you are such a wicked person. "Do unto others as you would have them do unto you". Do not forget you can be on the receiving side. How will you enjoy being mistreated when you are sick or old. You can be healthy today but tomorrow be on a hospital bed.
Why are you supporting evil done just because it's done by your Kenyan fellow? Grow up and stop being so naive
Uh...yikes...imagine justifying murder with "why didn't her kids take care of her?" So according to your argument...parents who take their kids to daycare are neglectful. Parents who send their kids to school instead of home schooling them are also neglectful? if the same thing happened to a child in a daycare Center run by Kenyans...should the parents not seek to prosecute since it’s their fault. They should’ve quit their jobs and stayed home with the child?? Or if a child was murdered in school. Is it the parents fault since they chose not to home school their kids? Your argument is flawed. This was murder and I hope these people are prosecuted to the fullest extent of the law. The family was paying them to take care of their loved one because they were unable and in return their loved one was murdered. Whether they put this elderly woman in a nursing home out of sheer laziness or necessity is not even part of the discussion. WHY this woman was in the nursing has nothing to do with anything!!!! It is not a justification for what happened to her. It is not a reason to neglect her. It is NOT a justification for MURDER!! I do not care why this woman was in that nursing home. The judge will not care WHY this woman was in the nursing home. The issue is that she died when she didn’t have to. She was MURDERED plain and simple. Your justification is dumb!!
Naah...they just need good lawyers. Once you make a decision to turn your "loved" ones into another's care, you accept some kind of risk...ask insurance companies that. There is no murder here. Am sure records will show the poor lady had attention seeking issues or due to her mental status, was not easy to manage. Now, her family had an option to take her to a one-on-one more private facility. Heck, stay with her and bring in a nurse. The probably did not due to financial constraints. Most of you argue as if these good homeowners willing to care for parents "disowned" by their kids get tons of money. The poor lady had a room-mate, and knowing a thing or two about state compensation, it was not a lot of money for the Cubis.
The woman was 95. At that age, with dementia, matter of fact, such deaths are quite common. She did not have much of a life ahead of her. And that will be considered in court. A good lawyer, is all we need. I rest my case.
@seneca - most, “I mean most”, of what you are saying here is purely based on several flawed assumptions; which are mostly wrong if carefully scrutinized at face-value perspective!
Legally - your flawed thinking won’t see the light of the day in any judicial circle in America. Your Kenyan friends surely neglected your 95 year old grandmother, and eventually caused her to die. So sad indeed!
No excuse here if you can’t take care of the elderly don’t F$$$ do it it’s easy money but this is what happens when people get greedy they forget their job🙄
You have the nerves to say the lady keep throwing herself on the floor 😳🤯why was her bed not lowered to the floor and why didn’t they have bed mats on the floor are you kidding me😏
Dementia is a disease!! Fool
@seneca - your suggestions here are of a criminal mind brewed from the motherland. Wrong is wrong any where in this world, for God’s sake!
You should never abuse the weak, the sick, the elderly, the needy and more importantly the helpless children!
Where is your moral compass located deep in your heart?
You sound like a willing corrupt accomplice in the criminal behavior by the owners of this facility.
I’d like to meet you face to face sometime.
Are you smiling at the camera in a state of confusion or just cannot believe it like it is your first time in court.Ignorance is bliss you have no idea what awaits you.Your wife just escaped maybe she knew what was coming and decided to run for dear freedom if only until they catch her
There is something called urgency of care and compassion.Am not against our people but know what the system requires of you even out there.....This is not only in this home, even with your kids...urgency of care, know human services, know basic laws, and yes cover your butts and do what is required all the time. You don't know who is watching....including hidden cameras

If you cannot stand the heat get out of the Kitchen. Many Kenyans copy each other especially in home care business in Washington state. Why do something that is not in you because you friend told you that home care is a killing business. If you have no heart of dealing with old people or disabled people why do it. It is not for everybody.
@ Kenya, I salute what you just said. It is so blinding for Kenyans to open home care businesses cause they see another person doing it just for the money 💰. Sounds like bad Karma if you have no good intentions to actually take care of these old folks. Like you said this is like a plague in Washington State! My goodness there are so many jobs/careers out there. Put your foot down and do what you love doing not just for the money. An average income of 9-5 with weekends off is life refreshing compared to high income working all week 24hrs.
@Mos, I have been telling people not only Kenyans to think a thousand times before getting into the AFH business. It is not really a money making business. One must be patient, one must love to care for people that are sick, physically and mentally, one must be conscientious and knows how to follow required state rules and fear in God. If not, the business will get you in big trouble. The purpose of the AFH is not to make big money it is a volunteer job to help the vulnerable, disabled and sick and to help the AFH owner and their family to have a roof over their head and have a small income to meet the family needs at the home helping other that are needing care. People are making it a money making machine or with a wrong conclusion it is a money making business. People did not study the negative side of it. To tell frankly, it has more negative side than positive. I had a home before I became a private investigator and AFH consultant that is why I know. The business will take ones time to his/her family and will take ones time to take care of himself/herself. There is no peace of mind day and night specially when there are sick client, wanderer or exit seekers. When the AFH has no clients the providers are having headaches on how to pay the bills and of course the worries if one get cited and get penalized by the state. If one does not have all the criteria I mention above and thinking of making big money People must just find jobs that they can go home at the end of the day without worrying tons of things. Life is short and the family needs each other time.

We may destroy the videos but we cannot destroy God's eyes. He is the eye of the blind. Redeemer and the Great Judge. We all work hard for our money. No short cuts. Wake up at 4am if that's what you signed up for. Tusijiharibi jina.
Waafrika tuna upuzi. The people who brought the gods we worship do not even worship those gods. If you cannot take care of your parents (the bible does not say to download them somewhere), don't expect much.
Seneca, your words are like honey .. leave these house negroes be

Here we go again! Is anyone of the opinion that Kenyans are being set up with abuse cases like the one above? Client abuse cases at work or private companies (especially with Kenyans in diaspora) have been frequent of late. I Kenyan owned businesses are not targeted!@ my 2 cents!
Compassion and integrity are indispensable to this industry.. if you don't have both, this is an unforgiving experience... sad about their plight but sadder for the ones that innocently left their loved one with the home.
It Is Time We Talk!
Many people are falling in this trap.
Many familes are putting cameras for two reasons
1.Safeguarding their families
2.Lawsuits
Up to now, you should know, there are a lot of people getting into trouble because they are ignorant or Lazy to look at the news and see what families are doing and how people are falling in this trap.
White people are not falling in this because they know what families are doing and they try to cover their behind.
If you are going to do this business/career, one has to be very flexible to change their thinking and know there is a lot to loose if things go wrong(better be in the safe side).
It's time for our people to stop thinking in Kenyan way when in a system that is full of things that can put you in jail in a second. Some things can not even cost you much to do, like caring for the patient you have taken in and being paid, when they have fallen, actually it is the right thing to do and you are in the safe side too.
We Kenyans need to know, not unless you live by yourself, any other human being that need care in time of need and if not lendered on time and you are Present, in this part of the world, you can be held liable. Out there in the community, is a different ball game, but you need to check your state law. We are all Individualistic in this country but Let's stop being ignorant, let's not pave a path these court system for the prosecution of our people or our kids to be that easy. You know when they start, they don't stop.
As more and more people go to open these homes, it is high time for our people to have a real candid conversation.
30 years or any jail time, is not anybody's cup of tea and not worth to come to America!
Very sad situation. This problem would have been solved if they did the right thing which everyone is trained to do, that "if a client falls, call 911", plain and simple. My question is, how hard was it to dial 911 at 430am? Seriously good people, let's have a conscience and live by the golden rule. As it is, it's still in Washington that an older woman shot 2 kenyans, killing one and I haven't heard of what was done to the old woman. Let's remember tuko kwa wenyewe and know that the stakes are against us.
Money money Greed Greed is what our pples have. Its very simple if u open such bizness for money u will b doomed??As somebody said compassion n integrity must b in you otherwise if it's for cash u can get finished quick.Just report document anything about yr patients. If u must ting ambulance n or take the patients to emergency please do it.It will cost u the time or another staff but ur covered for life.Document Documents n make emergency clinics/hospitals yr fred? They r paying for them bills anyway!!!!Commonsence. Also it's good to have 3/5 patients which ur available to work for that opening many homes for money money which u wont
But why are you, fellow Kenyans, quick to condemn this family, without listening to their version of the story? Vitu kwa ground huwa tofauti. You base yuour judgements (some of you sound jealous because you cannot start anything) on the prosecution's story. Do you see Indians doing that? Or are you the morality captains of the USA? I see no evil in this family. Just a good Kenyan family that opened their hearts to the old and disabled. Until I hear their version...for all I know, Patrick may have swatted her hand because she was pinching him. Why do you hate on your own so easily? Who cursed you Africans/Kenyans? Have you not seen in this country, evidence manipulated to put black people away? Until I get a picture/testimony of the Cubis, I pray that God gives them strength. Continue supporting the other team, see if they will escort your carcass to JKIA.
Woi! @ Seneca, you are on a different level. You do have a point though since they are presumed innocent until proven guilty. Unfortunately if charges were filed based on the video evidence I would be inclined to think that there is possible substance in wrong doing. I am not a lawyer but I can say am familiar with American law. Even if the client pinched him, he did not have the right to retaliate as she is deemed defenseless due to her health and she does not pose any harm. Please, if you are on American soil familiarize yourself with the law and follow it to stay out of trouble. That means incase of workplace violence or mistreatment then report it through chain of command and don’t take matters into your own hands.
@Seneca, with that kind of attitude and mentality. It will not take long to see yourself in prison. Just follow the rules na usifunike makosa ya wenyewe.
If you decide to go into this business there is no justification for treating the elderly poorly. Especially ones with dementia. You do the crime you do the time. Especially when you are caught on camera. No need to justify your wrong doing simple

@Seneca, I don't know if it is worth my time to say, nobody here is condemning the family but it is commonsense going by Mwakilishi, which does a due deligence in their reporting that, the Prosecutor bases her/his case based on the camera footing. If people start thinking it is jealousy and not tying to be careful and give it a good thought, know what is required of them or what they are getting into when operating such businesses, then my friend, we will continue to see more and more cases like this. Most people who are commenting are voicing what is required according to the camera footage which is in court.
I don't deny the deck is against alot of communities or social status in this country, but also, alot of people are in this industry of health care and Legal profession or living safe from problems by doing what is required.
If you go around blaming everyone and everything, then you miss the Point.
Goodluck and let's learn so that we don't keep repeating the above!
We keep fighting for justice as blacks, is this justice? We must learn to respect and accord the necessary care in an humane manner, irrespective of color, race, religion etc Always remember at some time, we'll all have old ones to care for or in someone's care. How would you feel if your parents, brother, sisters uncles, aunt's are treated like this?? Think and be wise, Karma comes back in full swing
Mai many Kenyans are I this business for money , I suggest they stop giving them licenses and authorizing them to help the elderly
Now you, with? Kenyans should be denied licences? Trust Africans to destroy each other.
@Daniel, there are no Kenyans in America, everybody here is treated at an individual level. What was here is negligence.
All that would happen is, if these cases keep happening in that state, then Prosecution would be very easy for any other person and fairness in the mind jurrous will be bent coz this is reported in the community by the media......
Sad situation. Unless you have an RN or higher who can assess that patient ASAP, send them to ER. If it’s not a witnessed fall, you have no way of knowing if they hit their head. Send them out to ED ASAP. If you’re in doubt, send them to ED! It costs you nothing to make that call. It’ll save your life and business. If they’d done that they wouldn’t be in this mess. They can’t be punished for a patient falling. But for negligence that followed. Ignoring a problem doesn’t make it go away. And please, be nice and genuinely care for people you’re entrusted to care for no matter how difficult they’re are. #OneLove
We Kenyans run where we hear there is money look what is happening in Massachusetts after home care scandals... This people clearly lacked basic knowledge of taking care of this kind of person... why call EMT and not send her to the hospital just for check up to be on save side given her age... am sure its because when you send pt to hospital you dont get paid..... now am sure they will change rule making it harder to people to open this homes
If you can't Put up with your "unable" Clent, just let the Clent Go somewhere else. It ain't worth Easy money when it Causes you Stress; and eventually Prison time.
