Three Kenyans - a husband, wife and their daughter - were charged with criminal mistreatment on Friday in Puyallup, Washington after a 95-year-old woman fell inside an adult family home they own.
Prosecutors say the woman, Betty Torrey, feel inside the home in November and died in the hospital 11 days later. Puyallup police say video footage shows Torrey fell and cried for help and caregivers responded, but that they left her on the floor unattended for several hours until morning when someone called 911.
Charging documents have identified the three caregivers as Patrick Cubi Mbiri, his wife Lilian Wambui Cubi, and their daughter Santana Wangui Cubi, according to Patch.com. The incident happened at Able Care, a group home that is owned by the family.
Detectives say from the video footage, Torrey fell at 4am on November 13th, and that Lilian was seen entering the room and scolding her to get back to bed. Torrey asked for help again and Lilian and Santana responded to the call. A few minutes later, prosecutors say Torrey called for help yet again and fell out of bed, at which point Patrick entered the room “and slapped Torrey's hand as she was grabbing at the curtains, trying to get up. Prosecutors said Mbiri did not attempt to help, despite repeated requests for a doctor,” according to Patch.com.
Prosecutors say Torrey, who suffered dementia, said her leg was broken and she needed to see a doctor, but that her request was ignored. It was not until 7am that paramedics were called to help get her to bed, but that the defendants did not mention Torrey had fallen out of bed, instead saying she has a light “assisted fall.”
“The co-defendants did not mention that she had fallen out of bed at 4:30 a.m. and instead reported that she had a light assisted fall (which is contradicted by the video footage)… At the time, likely due to dementia — Torrey did not indicate any concerns to the EMTs that her leg was broken — even though she repeated(ly) verbalized that a few hours earlier,” ” the probable cause statement said.
At a cardiologist appointment later that day, the doctor noticed Torrey had a swollen leg and unable to bear any weight on it. She was admitted to Good Samaritan Hospital with a complex femur fracture and died 11 days later due to complications from the injury.
Prosecutors say Torrey’s fall was only discovered after Torrey’s granddaughter learned from Torrey’s roommate at the group home informed her that Torrey had fallen. Shen then reviewed the video footage and called police.
Patrick, Lillian and Santana have all been charged with second-degree criminal mistreatment in Pierce County Superior Court. Patrick faces an additional charge of fourth-degree assault. Pierce County Superior Court Commissioner Craig Adams ordered them each held in lieu of $75,000 bail. Lillian was said to be out of the country last week, and authorities said they would seek a warrant for her arrest.

@Seneca, that is part of the job. When you go for training you are taught that some residents need 24/7 supervision on 1-on-1. You can not get a license without taking those training and pass. When wanted to save money by not providing this cucu 1-on-1 care.

@Senaca, like you say, this must have been a very difficult situation for our dear Kenyans. They were obviously very ill equipped and overwhelmed to handle this situation to make appropriate and timely intervention. I do not think they are bad people, or uncompassionate but they needed to have educated themselves to handle such a situation. Fact is, this elderly lady was a vulnerable adult and despite all the behavior described they should have handled this situation better. I do hope the Cubis and other Kenyans can learn from this. Before you envision big bucks envision this situation.

Naah...they just need good lawyers. Once you make a decision to turn your "loved" ones into another's care, you accept some kind of risk...ask insurance companies that. There is no murder here. Am sure records will show the poor lady had attention seeking issues or due to her mental status, was not easy to manage. Now, her family had an option to take her to a one-on-one more private facility. Heck, stay with her and bring in a nurse. The probably did not due to financial constraints. Most of you argue as if these good homeowners willing to care for parents "disowned" by their kids get tons of money. The poor lady had a room-mate, and knowing a thing or two about state compensation, it was not a lot of money for the Cubis.
The woman was 95. At that age, with dementia, matter of fact, such deaths are quite common. She did not have much of a life ahead of her. And that will be considered in court. A good lawyer, is all we need. I rest my case.

If you cannot stand the heat get out of the Kitchen. Many Kenyans copy each other especially in home care business in Washington state. Why do something that is not in you because you friend told you that home care is a killing business. If you have no heart of dealing with old people or disabled people why do it. It is not for everybody.
@ Kenya, I salute what you just said. It is so blinding for Kenyans to open home care businesses cause they see another person doing it just for the money 💰. Sounds like bad Karma if you have no good intentions to actually take care of these old folks. Like you said this is like a plague in Washington State! My goodness there are so many jobs/careers out there. Put your foot down and do what you love doing not just for the money. An average income of 9-5 with weekends off is life refreshing compared to high income working all week 24hrs.

One must be patient, one must love to care for people that are sick, physically and mentally, one must be conscientious and knows how to follow required state rules and fear in God. If not, the business will get you in big trouble. The purpose of the AFH is not to make big money it is a volunteer job to help the vulnerable, disabled and sick and to help the AFH owner and their family to have a roof over their head and have a small income to meet the family needs at the home helping other that are needing care. People are making it a money making machine or with a wrong conclusion it is a money making business. People did not study the negative side of it. To tell frankly, it has more negative side than positive. I had a home before I became a private investigator and AFH consultant that is why I know. The business will take ones time to his/her family and will take ones time to take care of himself/herself. There is no peace of mind day and night specially when there are sick client, wanderer or exit seekers. When the AFH has no clients the providers are having headaches on how to pay the bills and of course the worries if one get cited and get penalized by the state. If one does not have all the criteria I mention above and thinking of making big money People must just find jobs that they can go home at the end of the day without worrying tons of things. Life is short and the family needs each other time.

Here we go again! Is anyone of the opinion that Kenyans are being set up with abuse cases like the one above? Client abuse cases at work or private companies (especially with Kenyans in diaspora) have been frequent of late. I Kenyan owned businesses are not targeted!@ my 2 cents!
Compassion and integrity are indispensable to this industry.. if you don't have both, this is an unforgiving experience... sad about their plight but sadder for the ones that innocently left their loved one with the home.

Many familes are putting cameras for two reasons
1.Safeguarding their families
2.Lawsuits
Up to now, you should know,there are a lot of people getting into trouble because they are ignorant or Lazy to look at the news and see what families are doing and how people are falling in this trap.
White people are not falling in this because they know what families are doing and they try to cover their behind.
If you are going to do this business/career, one has to be very flexible to change their thinking and know there is a lot to loose if things go wrong(better be in the safe side).
It's time for our people to stop thinking in Kenyan way when in a system that is full of things that can put you in jail in a second. Some things can not even cost you much to do, like caring for the patient you have taken in and being paid, when they have fallen, actually it is the right thing to do and you are in the safe side too.
We Kenyans need to know, not unless you live by yourself, any other human being that need care in time of need and if not lendered on time and you are Present, in this part of the world, you can be held liable. Out there in the community, is a different ball game, but you need to check your state law. We are all Individualistic in this country but Let's stop being ignorant,let's not pave a path these court system for the prosecution of our people or our kids to be that easy. You know when they start, they don't stop.

Very sad situation. This problem would have been solved if they did the right thing which everyone is trained to do, that "if a client falls, call 911", plain and simple. My question is, how hard was it to dial 911 at 430am? Seriously good people, let's have a conscience and live by the golden rule. As it is, it's still in Washington that an older woman shot 2 kenyans, killing one and I haven't heard of what was done to the old woman. Woi! @ Seneca, you are on a different level. You do have a point though since they are presumed innocent until proven guilty. Unfortunately if charges were filed based on the video evidence I would be inclined to think that there is possible substance in wrong doing. I am not a lawyer but I can say am familiar with American law. Even if the client pinched him, he did not have the right to retaliate as she is deemed defenseless due to her health and she does not pose any harm. Please, if you are on American soil familiarize yourself with the law and follow it to stay out of trouble. That means incase of workplace violence or mistreatment then report it through chain of command and don’t take matters into your own hands.

@Seneca, I don't know if it is worth my time to say, nobody here is condemning the family but it is commonsense going by Mwakilishi, which does a due deligence in their reporting that, the Prosecutor bases her/his case based on the camera footing. If people start thinking it is jealousy and not tying to be careful and give it a good thought, know what is required of them or what they are getting into when operating such businesses, then my friend, we will continue to see more and more cases like this. Most people who are commenting are voicing what is required according to the camera footage which is in court.
I don't deny the deck is against alot of communities or social status in this country, but also, alot of people are in this industry of health care and Legal profession or living safe from problems by doing what is required.

All that would happen is, if these cases keep happening in that state, then Prosecution would be very easy for any other person and fairness in the mind jurrous will be bent coz this is reported in the community by the media......
Sad situation. Unless you have an RN or higher who can assess that patient ASAP, send them to ER. If it’s not a witnessed fall, you have no way of knowing if they hit their head. Send them out to ED ASAP. If you’re in doubt, send them to ED! It costs you nothing to make that call. It’ll save your life and business. If they’d done that they wouldn’t be in this mess. They can’t be punished for a patient falling. But for negligence that followed. Ignoring a problem doesn’t make it go away. And please, be nice and genuinely care for people you’re entrusted to care for no matter how difficult they’re are. #OneLove

This people clearly lacked basic knowledge of taking care of this kind of person... why call EMT and not send her to the hospital just for check up to be on save side given her age... am sure its because when you send pt to hospital you dont get paid..... now am sure they will change rule making it harder to people to open this homes
