Big Win For Wavinya Ndeti as High Court Reinstates Her Back to Machakos Governor Race
The High Court has given Machakos Gubernatorial candidate Wavinya Ndeti a political lifeline after it quashed the decision by Independent Electoral and Boundaries Commission (IEBC) dispute resolution committee to bar her from contesting for Machakos governorship.
The IEBC committee had defended its decision to bar Wavinya from contesting for the Machakos top seat, arguing that the Wiper Party candidate employed political mischief hatched by the Wiper Party to bypass party resignation ruled, and therefore, was not qualified to vie under Wiper
The former Kathiani MP however maintains that t she had followed the due process to ensure she was in Wiper Party's list before the deadline set by the poll body, which was her main point of argument before Justice George Odunga.
IEBC lawyer Paul Nyamodi told the court that Wavinya based her membership to Wiper through a coalition agreement with Chama cha Uzalendo (CCU) dated April 24 this year, and was therefore ineligible to contest under the Kalonzo Musyoka-led party.
But delivering the ruling on Wednesday Morning, Justice George Odunga ruled that Wavinya Ndeti was eligible to run for Machakos governor seat on Wiper Party ticket, as the move by the IEBC to bar her had no legal basis.
