NASA Mounts More Pressure on IEBC With a Fresh Court Battle

National Super Alliance (NASA) is mounting more pressure on the Independent Electoral and Boundaries Commission (IEBC) in a fresh legal battle, just days after the opposition’s petition of constituency presidential results be final was granted by the Court of Appeal.

NASA will be moving to court in a new petition that is seeking to have the court compel IEBC reveal the complementary results transmission and voter identification mechanisms it will be employing in the August 8 elections.

NASA wants IEBC to pronounce the mechanism at least 30 days before the polls are conducted.

“We will be heading to court next week to lodge this petition,” Paul Mwangi, the head of presidential candidate Raila Odinga’s legal team said.

 “In the alternative, an order compelling the respondent to develop, in consultation with the petitioner and the public at large, the complementary mechanism for identification and transmission of election results as envisaged by section 44A within a reasonable period before August 8, 2017, but in any event within 30 days before the said date,” reads the petition.

 “The Respondent has despite the said provisions and with less than 54 days to go before the general elections failed, refused and/or neglected to put in place the said mechanism in consultation with the public or at all and has additionally refused to provide information regarding the said system,” the petition further reads.

IEBC has faced several legal battles lodged by NASA, right from the ballot printing tender that it was ordered to retender, poll tallying petition, and yet to be determined ballot printing tender that NASA is seeking to have the tender awarded to Dubai based firm, Al Ghurair stopped.
