Attorney General Githu Muigai Asks Court to Stop NASA from Removing IEBC Officials from Office

The State wants the High Court to block opposition leaders from pushing for the ejection of some Independent Electoral and Boundaries Commission (IEBC) officials from office.

While submitting before the court in a case filed by 12 Nakuru residents, Attorney-General Githu Muigai said that the move by National Super Alliance to seek removal of Independent Electoral and Boundaries Commission officials was unconstitutional.

The petitioners, through lawyer Kibe Mungai lodged the petition under certificate of urgency last week, seeking to compel the court to order the opposition leaders from further pushing for the removal of the officials.

The 12 petitioners are seeking orders from the court blocking the opposition leaders led by Nasa presidential candidate Raila Odinga from interfering with the working of IEBC, as it prepares to deliver the fresh presidential election set for October 26th.

In his submissions through State Counsel Jennifer Gitiri, the Attorney general argued that Nasa's push were meant to cripple the electoral commission and block it from performing its mandate as provided for by the Constitution

He termed the push as unconstitutional and further argued that it contravened the findings of the Supreme Court, which overturned President Uhuru’s victory last month.

“The Supreme Court was categorical that it is the IEBC, which is composed of commissioners, to conduct a fresh presidential election,” he said
