Raila Wants Ekuru Aukot Name Included in the Ballot for Repeat Election
National Super Alliance (NASA) presidential candidate Raila Odinga wants Thirdway Alliance Ekuru Aukot's name be included im the ballot paper for the repeat presidential election slated for October 26.
Submitting to a case in which he has been named as a respondent, the Orange Democratic Movement leader argued that the Supreme Court overturned the entire presidential poll and thus the need to include all candidates nominated in the nullified August 8th poll.
“In the event the determination and the Constitution presupposes that all persons who participated in the nullified presidential election of August 8, 2017 did not, in the eyes of the law, participate in the said presidential elections at all and are accordingly entitled to the opportunity offered by the constitution within the meaning to do so in the upcoming presidential election now scheduled for October 26, 2017,” replied Raila.
Through his lawyer Jackson Awele, the former Prime Minister noted that the gazette notice by Independent Electoral and Boundaries Commission (IEBC) announcing the race will bs between him and President Uhuru Kenyatta is null and void for failing to include other candidates.
Responding to the same case, the electoral commission opposes the inclusion of Aukot and other candidates, citing Supreme Court ruling in 2013, which defined a fresh election as one between the petitioner and the previously declared winner im the nullified election.
The rest of the candidates who did not challenge the election of the President-elect are assumed to have conceded defeat, IEBC argued.
