High Court Declares Election of Homa Bay Governor Cyprian Awiti Null and Void

The election of Homa Bay Governor Cyprian Awiti has been has been declared invalid, null and void by High Court.

Delivering the ruling on Tuesday morning, Justice Joseph Karanja said the court found that the Independent Electoral and Boundaries Commission (IEBC) failed to conduct a free and fair election.

The annulment follows a petition lodged by former Kasipul Member of Parliament Oyugi Magwanga, who run against Awiti in the Homa Bay gubernatorial contest during the August 8th,2017 elections.

In his petition, Magwanga, who run as an independent candidate said the election was marred with massive irregularities. Justice Karanja said the petition presented enough evidence to warrant a nullification.

Consequently, the electoral commission has been directed to conduct a fresh election, with strict adherence to the Constitution and election laws.

The Orange Democratic Movement (ODM) governor becomes the second county head to lose his seat, after Wajir's Ahmed Mohammed Abdi Mahamud was voided on January 12th.
