Relief for Former Senator Joy Gwendo as High Court Revises Her Two-Year Prison Term

The High Court has revised former TNA Nominated Senator Joy Gwendo's sentence in a case where a lower court handed her a two-year prison term.

In his ruling on Monday, Judge John Onyiego noted that the lower court erred in law by sentencing her to prison without the option of a fine.

The judge further noted that the cash Ms. Gwendo had stolen had been fully paid.

Consequently, the court has ordered the politician to pay Sh660, 000 fine or spend a year in jail.

Ms. Gwendo was on December 7th, 2018 sentenced to a two-year prison term after she was convicted with abuse of office and fraud.

In the ruling, Magistrate Douglas Ogoti jailed her without the option of a fine for ‘hoodwinking the court.’

Ms. Gwendo had been accused of using her position as a State officer to steal Sh2,226,800 from the Kisumu East Cotton Growers Cooperative Society through Kivali Development Initiative.

The offense was allegedly committed on October 23rd, 2016 at Chiga Parish in Kisumu County.

She was also charged with issuing two bad checks amounting to Sh1,250,000.
