Nairobi Matatu Driver Cries Foul over Acquittal of Police Officer Accused of Smashing His Testicles

A matatu driver has expressed his disappointment following the acquittal of a police officer accused of assaulting him in 2013.

43-year-old Ernest Nyamoti said the officer clobbered him after he was found to have violated traffic laws.

Nyamoti claimed that the officer severely damaged his manhood after the beating and was forced to undergo surgery.

He said he can no longer sire children since his testicles were permanently damaged.

“Where is justice in this country? What more evidence would the magistrate want? I’m alive and the doctors testified in my favor, explaining that my testicles were smashed and later removed?" he posed.

“I no longer have sexual feelings and I have no chance of fathering a child,” he added.

Nyamoti further noted that he spent Sh1.4 million to seek treatment.

In his ruling this week, Milimani Senior Principal Magistrate Kennedy Cheruiyot said the prosecution failed to prove the case against constable Jamal Hussein.

“After evaluating the evidence tabled in court, l find the prosecution has not established a prima facie case against the accused and I, therefore, acquit him under Section 210 of the Criminal Procedure Code,” ruled the magistrate.
