President Uhuru’s Kin Launches Fresh Bid to Reclaim Sh3 Billion Land Auctioned by Bank over Defaulted Loan
President Kenyatta’s cousin Ngengi Muigai has launched a fresh bid to reclaim Sh3 billion land auctioned by Kenya Commercial Bank (KCB) over a defaulted loan.
Ngengi is seeking to introduce new evidence in an attempt to convince the court to rescind its verdict on the dispute involving the 443-acre land.
The land located in Kiambu County was auctioned by KCB after Ngengi defaulted on loan repayment. The lender sold the property for Sh70 million in 2007 after successful litigation.
In 2017, a three-judge bench of the Court of Appeal ruled in favor of KCB, ending the 25-year-old dispute.
The court noted that further litigation of the case had to stop to protect the integrity of the court process as well as protect KCB from unending litigation.
Through lawyer Marete Githinji, Ngengi on Thursday told the Appeals Court that he has obtained compelling evidence that could reverse the 2017 judgment and give another in his favor.
He said he had not authorized the consent between him and KCB earlier entered in court. He wants the case to be heard by a five-judge bench.
“The issues we will be raising are so serious because they are likely to affect several judgments issued by this court on the subject matter,” noted lawyer Githinji.
Judges Roselyn Nambuye, Milton Makhandia, and Jamilla Mohamed directed that the file be submitted to the Appeals Court president to consider the request to expand the bench to five.
Ngengi, through his company Muiri Coffee Estate Ltd, used the land as security to secure a loan of Sh11.5 million from KCB in 1989.
