Court Stops Cremation of Late Kibra MP Ken Okoth as Nairobi MCA Claiming to have His Son Files Case
A Nairobi court has barred the family of late Kibra MP Ken Okoth from cremating or burying the deceased until a case filed by Anne Muthoni Thumbi is heard and determined.
“That in the interim a temporary injunction be and is hereby issued restraining the 1st and 2nd defendant (Okoth’s mother and wife), either by themselves, their servants or agents from conducting the burial, interment, cremation and or in any manner whatsoever dispose of the body or remains of the late Mr. Ken Okoth pending the hearing and determination of the instant application interparties,” the court’s directive reads.
Ms. Muthoni, a Nairobi County nominated MCA, filed a lawsuit on behalf of a minor, who she claims is a biological son of Mr. Okoth.
She has named Okoth’s mother Angeline Okoth, his wife Monica Okoth and Lee Funeral Home as respondents in the case.
Ms. Muthoni claims that Okoth’s family unilaterally decided to have his body cremated in order to destroy any evidence of the boy’s lineage to the deceased.
“The mother and the wife (of the deceased) have deliberately and unfortunately opted to exclude me from the funeral and burial arrangements of Okoth,” claims Ms. Muthoni, who is the minor’s mother.
The matter will be heard on August 9th, 2019 before Senior Principal Magistrate Hon. Obura.
Speaking at MP Okoth’s funeral service in Moi Girls High School in Nairobi on Thursday, Governor Mike Sonko shockingly claimed that the late politician had a second wife- Ms. Muthoni.
“The Late Ken Okoth has a child named Okoth with one Annitah, who is a nominated MCA in the County Assembly of Nairobi. Let us not lie to ourselves,” Sonko said.
