MP Babu Owino Asks Court to Review Sh10 Million Bail, Says He’ll Struggle to Raise the Amount

Embakasi East MP Babu Owino on Thursday moved to court seeking to have his Sh10 million cash bail reviewed.

Babu was on Monday released on a cash bail of Sh10 million with Chief Magistrate Francis Andayi directing him to pay the amount in four installments of Sh2.5 million each over the next four months.

In an application filed at the Milimani Law Courts on Thursday, Babu, who is charged with attempted murder and disorderly behavior over the shooting of Felix Orinda, alias DJ Evolve, said he will struggle to meet the remaining installments as directed by the court.

Babu was released from Industrial Area Remand Prison on Tuesday after he deposited the first installment of Sh2.5 million.

“I have partially complied with the terms as set out and thus I am out on bail but I know that I thus would also appreciate an and above a reduction of the amounts stated being Sh10,000,000 million,” reads court papers.

“Despite the fact that I had voluntarily started assisting the victim in meeting the medical expenses and had pledged to voluntarily continue doing so, at no point was it to depict an admission of guilt as the Court seems to have depicted and thus the same should not be used to render high or punitive bail terms,” Babu adds.

He pleaded with the court to revise the bail granted by magistrate Andayi in line with the constitutional rights of an accused person and in the interest of the right to a fair hearing and the rule of law.

In his ruling on Monday, Andayi noted that the Sh10 million would be used to settle the victim’s medical bill with the remaining serving as bail. He also barred Babu from indulging in any form of narcotics or alcohol in a public establishment.
