CJ Maraga Child Support Case Dismissed After Mary Kwamboka Fails to Appear in Court

A Nairobi court has dismissed a child support case filed against Chief Justice David Maraga. 

The case was struck out on Wednesday after the applicant, Mary Kwamboka Onyancha failed to appear in court or send an attorney to represent her.

Children’s Court Magistrate GM Gitonga further ruled that the application was not properly filed as the applicant failed to pay the requisite fee of Sh655.

Kwamboka accused CJ Maraga of running away from parental responsibilities and wanted the court to compel him to support a six-year-old child they allegedly got together in 2014 after an intimate relationship.

She was demanding a monthly child upkeep of Sh160,000 including Sh20,000 for food, clothing (Sh5,000), house rent (Sh45,000), school fees per term (Sh41,600), medical cover (Sh20,000), house help (Sh10,000) and Sh20,000 for entertainment.

Kwamboka caused drama outside Milimani Law Courts in Nairobi last month by shouting that CJ Maraga had fathered her child and was not providing for her.

But Maraga through his lawyers Danstan Omari, Samson Nyaberi and Anita Masaki accused the woman of forging the child’s birth certificate to tarnish his name. 

“That birth certificate is generated, it is not a document to be relied on,” Omari said. 

“If this is aimed at assassinating the character of the Chief Justice, it is our position we shall be calling on the DPP and all relevant arms of government to get to the root course of this fraud,’’ he added.
