DPP Orders Arrest of Former Kenya Ports Authority MD Daniel Manduku over Sh244 Million Illegal Tender

Director of Public Prosecutions (DPP) Noordin Haji has ordered the arrest and prosecution of former Kenya Ports Authority (KPA) Managing Director Daniel Manduku.

This comes after Haji approved charges against him over his alleged involvement in irregular procurement amounting to Sh244 million at KPA in the 2018/2019 fiscal year.

Investigations established that Manduku sanctioned the manufacture of concrete barriers at the Inland Container Depot, Kilindini Port and Makongeni Goods shed without an approved budget and procurement plan, according to Haji.

Manduku is further accused of handpicking the 10 companies that were awarded the contracts for the manufacture of the concrete barriers contrary to procurement regulations.

“There was no requisition made for concrete barriers by the user Department within the KPA as required under the Public Procurement and Asset Disposal Act, 2015(PP & AD Act, 2015) and the Regulations made thereunder,” said Haji in a statement on Thursday.

Investigators further established that KPA made an overpayment of Sh244,837,908.59 to the contractors for work not completed.

Manduku will face charges alongside Juma Fadhili Chigulu, a KPA Works Officer who is said to have approved the irregular payments.

“I am satisfied that there is sufficient evidence to support charges for various criminal offenses against Daniel Ogwoka Manduku, former Managing Director, KPA and Juma Fadhili Chigulu, Works Officer, KPA,” added Haji.

Manduku stepped down from the top position in March this year after the multi-million-shilling scandal was uncovered by the Directorate of Criminal Investigations (DCI). He said he arrived at the decision to resign after deep introspection and lengthy consultations.
