DPP Wants Waititu Examined After Skipping Third Court Session Claiming He is Sick

The Director of Public Prosecutions (DPP) wants former Kiambu Governor Ferdinand Waititu subjected to a medical examination to ascertain that he is unwell.

This comes after Waititu failed to appear in court on Monday for his corruption case for the third time citing medical reasons.

His lawyer John Swaka told the court that his client was recently admitted to the hospital but the prosecution accused him of faking his illness to delay the hearing of the Sh580 million corruption.

“Waititu has been placed under bed rest, we hoped an improvement by today, he went for further review on 24th and the doctors ordered him to be admitted,” said Swaka.

“When Waititu was suffering from COVID-19, the court ordered the documents to be investigated and indeed, a report was filed in court,” he added.

On Monday, the prosecution asked the court to provide three doctors appointed by the Kenya Medical and Dentists Practitioners Board (KMPDU) to examine Waititu to establish whether claims that he is sick are true.
 
“From the conduct of the accused, it shows that he is not willing to proceed with the hearing. The record speaks for itself. On January 20, an application was made an attempt to impeach the proceedings,” the prosecution said.

The prosecution claims that medical reports provide indicate that the doctors attending to Waititu are not genuine. 

The court will rule on the prosecution’s application on Wednesday.
