Court Dismisses DJ Evolve's Bid to Withdraw Attempted Murder Case Against MP Babu Owino
A Nairobi court has dismissed an application by Felix Orinda, alias DJ Evolve, seeking to withdraw an attempted murder case against Embakasi East MP Babu Owino.
On Monday, Magistrate Bernard Ochoi of Milimani law courts ruled that the unconditional withdrawal of the case is inappropriate, adding that MP Owino must disclose to the court what he has offered DJ Evolve’s family.
The magistrate further stated that DJ Evolve failed to disclose to the court whether compensation has been made despite suffering serious injuries. He, however, pointed out that involved parties are at liberty to engage.
MP Owino was last year charged with attempted murder after he shot and wounded DJ Evolve at B-Club in Nairobi’s Kilimani estate.
Owino was in January 2020 freed on a cash bail of Sh5 million after he pleaded not guilty to charges leveled against him.
Following the shooting, DJ Evolve was admitted to the Nairobi Hospital for six months, where he underwent multiple surgeries before he was discharged in June to recuperate at home.
