Kenyan Woman and Her Estranged Danish Husband Fight for Sh12 Million Home

A Kenyan woman is embroiled in a fight for a Sh12 million matrimonial home in Malindi, Kilifi County with her estranged Danish husband. 

Vivien Nasimiyu Wamalwa sued her estranged husband Wesche Simon Enna, accusing him of blocking her from accessing the property after their breakup.

While the woman accuses Simon of taking advantage to lock her from accessing the home when she was away after the breakup, the foreigner claims it was his estranged wife who took advantage when he flew out of the country to take possession of the property.

Senior Principal Magistrate J Ong’ondo issued orders stopping Simon from limiting the woman’s access to the property until her case is heard and determined.

“The respondent, Wesche Simon Enna, his agents or any person acting on his behalf are hereby restrained from evicting her or interfering with her access to the matrimonial home known as Harbour Cottage pending determination of the dispute,” ruled Ong’ondo.

The magistrate further barred the respondent from selling or disposing of the matrimonial home or altering names of beneficiaries until the suit is determined.

Through her lawyer, Nasimiyu told the court that they jointly own the property but after they separated briefly due to domestic fights, the man changed all the locks and instructed a security guard not to allow her in.

“He excluded his wife from using and accessing their matrimonial home despite having equally contributed to the purchase of the property,” lawyer John Swaka submitted.

In response, Simon accused Nasimiyu of tricking him to include her name in the sale agreement when she did not contribute anything towards buying the home.

The Danish national said he singlehandedly paid Sh10.5 million purchase price and spent an additional Sh2 million on renovation after selling some of his properties in Denmark.
