Kenyan Entertainer Arrested for Allegedly Raping a British Woman on MSC Fantasia Cruise Ship
A 37-year-old Kenyan entertainer was arrested on March 15 after allegedly raping a British female passenger aboard the MSC Fantasia cruise ship.
The female passenger, 27, accused the entertainer of assault during an onboard dance. The ship's captain promptly notified authorities, requesting their presence upon docking in Palma, Spain. Local police entered the ship and apprehended the suspect. While details remain scarce, officials confirmed the arrest and disclosed the suspect's refusal to answer questions during his court appearance.
An investigation is underway with police examining the suspect's phone for potential evidence. He was subsequently released on bail, though information regarding passport confiscation is unavailable. The alleged victim received medical attention at a nearby hospital. In a statement, MSC Cruises stated that they prioritize passenger safety and highlighted their rigorous code of conduct.
They further emphasise maintaining a zero-tolerance policy for any behaviour threatening passenger well-being. While citing the ongoing investigation, the company declined further comment. The MSC Fantasia, carrying over 4,000 passengers, continued its scheduled seven-day Western Mediterranean voyage despite the incident. MSC Cruises offers employment opportunities to qualified Kenyans. Their presence at the Port of Mombasa contributes to Kenyan job creation and the tourism industry's growth.
In April 2019, a similar occurrence happened in Valencia, Spain when an 18-year-old Italian male allegedly raped a 17-year-old British tourist aboard a cruise ship. The incident, which reportedly occurred in international waters after the vessel departed Palma, ignited concerns about jurisdictional limitations in such cases. Local reports from Spanish Newspaper Levante EMV detailed the harrowing experience of the British teenager, who, while travelling with her parents, reported being forced into the Italian teenager's cabin and subsequently assaulted.
However, when the case reached the Spanish legal system, a significant hurdle emerged. The Spanish judge assigned to the case determined that Spanish law lacked jurisdiction to pursue a criminal investigation due to the unique circumstances surrounding the alleged crime. The incident transpired on a Panamanian-flagged vessel in international waters, placing it outside the direct purview of Spanish legal authority.
