Miguna Fails to Get an Emergency Travel Document for a Second Day

Lawyer Miguna Miguna says officials at the Kenyan embassy in Berlin, Germany have for the second time refused to comply with a court order to issue him with a travel document.

Through Twitter, Miguna says he visited the embassy again on Tuesday carrying a copy of the order issued by High Court judge Hedwig Ong’udi on Monday. 

“I found three Kenyan Embassy staff - Alexander Karuma, Emma Malinda, and Esther Mungai - who showed so much hatred towards me and contempt for Court Orders that one would be mistaken to think that Kenya belongs to them,” Miguna tweeted.

“Ms. Mungai, Ms. Malinda, and Mr. Karuma refused to comply with the order.”

Justice Ong’udi directed Miguna to obtain a one-way emergency travel certificate from the Kenyan High Commission in Ottawa or the mission in Germany within 72 hours to facilitate his travel to Kenya.

Miguna visited the Berlin mission hours later but officials informed him that they received instructions from Nairobi to deny him the travel document.

“Amb. Tom Amolo hurriedly left at 2 PM. Ushered to the boardroom by Emma Mabinda, Karuma, and Esther Mungai and told that if they comply with Justice Ong’udi’s order and issue me with a travel document, they would lose their jobs,” Miguna claimed.

“Emma Mabinda specifically told me that she has received instructions from Nairobi not to comply with the court order.”

Miguna, who was deported to Canada in 2018, was set to travel to Kenya on November 16th but he was barred from boarding a Nairobi-bound France Air flight in Berlin over a red alert allegedly issued by the Kenyan government.

His lawyers moved to court seeking to have the red alert lifted, with Justice Ong’udi directing Miguna to obtain an emergency travel certificate.
