A landlord from Kiambu County has turned down a request by his tenants to offer them a 50 percent rent waiver amid the Covid-19 pandemic.
Residents of Jowac Apartments had sent the request to their landlord named Wambugu through a letter, saying the stay home order occasioned by the Covid-19 pandemic has taken a toll on their income, making it hard for them to meet their rental obligations.
"We are watching developments about coronavirus very closely and, as you might imagine, we are really concerned. Our financial circumstances have changed completely because of COVID-19 due to government’s advice on people to work from home.”
"Because of this, we would like to discuss the possibility of a 50% rent waiver for a period of May and June as we monitor how the situation goes bearing the fact that most of us are on unpaid leave," part of their letter read.
But in response, the landlord dismissed their request, noting that the property was built through a mortgage and that he is presently required to repay Sh1.04 million per month.
Besides, Wambugu asked the tenants not to assume that he earns more than them simply because he is a landlord, saying that most of them drive better cars than him.
"For your information, I am paying a loan of Sh1.048 million per month. Your request is untenable. Never assume that a person has more disposable income than you merely because he is your landlord.”
“Indeed, some of my tenants drive better cars than me. Most buildings are constructed using loans," he replied.

Tenants can request delay in payment but not forgiveness of rent. Loans must be serviced. I would have responded similarly.

Republicans control 2/3 of the government at the moment. The senate and the presidency. Democrats only control the house. A bill must go through all three to be signed into law.

You don’t know what you are talking about. The US Congress has 2 parts: the House and the Senate. The House can recommend a budget. The Senate can make changes and then approves it. It is the Senate that approved that bill and the Senate is controlled by Republicans led by Mitch McConnell.
Yes, the Democrats control the majority of the House of Representatives, which creates bills to then be voted on. Then said bills are sent to THE REPUBLICAN CONTROLLED SENATE (whom have already showed time and time again they have no interest helping the American people) to again be voted on. Now if that bill passes (they rarely do because most of the proposed COVID-19 relief bills have been geared towards helping the people, ie. stimulus checks, rent forgiveness, student loan forgiveness and other policy) it is then sent to the President to be either signed into law or vetoed. I have a friend who is wait staff at a local restaurant layed off during this pandemic. Her boss has asked her to return to work yet she refused. Her unemployment is just over $650 per week, close to three times what she made working.

He did buy a property he could afford, with the full amount of rent that's paid towards him to pay his mortgage. the issue is not the landlord's, the issue is the tenants, who live at the edge of their financial means and so within one month could not afford to pay their rent. Before you make such a remark of people living beyond their means, think twice, who would be renting if its not those people. I believe in an economy where people spend. I similarly have rentals and some of my tenants drive Range rovers and Land cruisers V8 while i drive a smaller car, yet i understand their situation and am open to discussions when approached.
The landlord has a mortgage too pay. If the financial institution doesn't give the landlord relief how can he give his tenants relief. If the tenants don't pay his loan goes into default, his credit suffers and there goes his business. It goes. Other ways.

NO ONE has ever considered a pandemic when making financial decisions. Not even big businesses, banks, individuals, etc....hell not even the Gov't. Did you? This pandemic has changed everyone for varying reasons.

We teach our financial students to prudently plan for emergencies by saving enough money to cover a half year of expenses, constantly rotating through a month of non-perishable food in case supplies are disrupted, and avoiding debt in case your cash flow is disrupted. Thus, when the pandemic hit, we were prepared.
This was actually common for those who survived the Great Depression, including my parents, who taught me. I suspect it will be a lot more common after the Great Pandemic as well. At least, it should be! Because this is not the last crisis of your life.

I'd just like to point out that the landlord's mortgage is for the building the tenants live in. If he hadn't taken the mortgage out their current homes wouldn't exist.

I own a rental unit. Ive never owned a car. Though i drive a borrowed car. I have not been paid 2 month rent by my driving tenants . I'm living on handouts from siblings.
Did you have a job before the pandemic or was your rental unit your only form of income? If you were furloughed, I feel for your situation. However if this rental was your only form of income, then you should probably think about getting a real job once this whole pandemic mulls over. Being a landlord isn't a job, it's being a leech.

Just before Covid-19 discovery in Kenya, the apartment I live in was auctioned. Now the new landlord came with new terms...like we've just rented. We paid new hiked rent + deposit as well as H²0/stima deposits.Don't joke!

The other day we were against the guy with a British style school and his expensive education and nagging so rich parents looking for a discounted tuition. Many of us were against him though in this case I see many supporting wambugu and his tuplots probably because we own some too hence the solidarity. I personally don't see any difference between these two. They are both businessman with loans to service. You as a customer you need to scratch where you can reach shine or rain. As the owner, if you loose your loyal customers who do you think is going replace them. Your house may be vacant for several months and end up loosing more than giving a two month rent break. It a win win situation.

Sadly it is a catch 22 for both tenants and landlords. If you were furloughed or have reduced hours because of covid19 you don't have funds to pay all the rent. It is simple math. If you are a landlord you also have bills to pay. The problem is tenants with no income and or reduced income means exactly that. Landlords not receiving rent payments from tenants means they are in the Same situation as their tenants which is ironic. Solution the tenant can try to move in with family or friends until things improve or try to reach a compromise with the landlord. Landlord can either work with the tenant as some money is better than none or risk the tenant moving out and hope someone moves in to make up for the tenant moving. Sadly there is no blame on either part as nobody expected a pandemic to happen. It sounds awesome to say have a back up plan but the reality is most people live paycheck to paycheck.

I agree with the landlord there are so many people taking advantage of this Covid-19 situation and not paying their rent. I have family members who are working and still don’t want to pay their rent because they feel like they don’t have too. Nonetheless, I am a renter living a beautiful 3 bedroom home. When I withhold my rent for various reasons. My landlord mortgage company place notices on the door because she is behind on the mortgage. If I was the landlord I would discount the rent from the tenants that can provide evidence that he or she have been laid off. The rest would have to pay the full rent.

Its a shame that human beings don't give a fuckin damn about each other. A problem like a pandemic, war etc should have every sector reducing prices. Companies claim to have made loses and have sent people on unpaid leave or those who are lucky to quarter salary. Some businesses are closed. A good reason never to be a landlord or a lender. The vast bulk of humans will rationalize their own self interest to the detriment of anyone who previously accepted their promises.
The correct response here? Perhaps extraordinary times call for some flexibility in lease terms. ie, "there is zero chance I can pay you". In such cases, the landlord might exercise his discretion and just allow the tenant to "move the hell out". But no tenant should expect a landlord to cut their rent or to forgive rents due. That's just theft.
