Joseph Kamotho’s Son Charged with Forging a Medical Report in Succession Row

The son of the late Kanu-era Cabinet minister Joseph Kamotho was on Wednesday charged with forging a medical report and filing it in court in order to disinherit his siblings of their late father's multi-million-shilling estate.

The court heard that Charles Githii forged a medical report showing that his sister Marianne Nyokabi Kamotho is of unsound mind, hence not fit to be administrator of the estate.

Githii appeared Chief Magistrate Wendy Kagendo at Milimani law courts where he pleaded not guilty to the charges and was released on Sh150,000 cash bail. He took plea after his request to resolve the matter out of court was dismissed.

He allegedly went to an unknown location within Nairobi in October 2015 and obtained a forged report signed by a doctor named Mucheru Wang'ombe, according to court documents.

Githii was charged with a second count of knowingly uttering the forged medical report he obtained from Dr. Wang'ombe with intent to defraud.

Kamotho, who died while undergoing treatment in a hospital in South Africa on December 6th, 2014, left his widow Eunice Wambui Kamotho and four children, Charles Githii Kamotho, James Mwai Kamotho, Marianne Nyokabi Kamotho and David Waweru Kamotho.

The widow sought letters to administer the estate but some of her children filed objections and the case has been pending in court since 2017.

The property left behind by the deceased includes five parcels of land in Gacharage, Murang’a, land in Kakuzi Murang’a, and a matrimonial home in Nairobi’s Kitisuru area. He also had shares in Safaricom, KenGen, Britam, Barclays, Sameer Africa, and had a bank account at Standard Bank.
