The plight of two Kenyan women, Egadwa Mercy Adamba and Gwaro Margret Sebina, has exposed the inadequacies of India's detention facilities for foreign nationals.
Arrested in January for lacking valid visas, the women were initially transferred from jail to a detention centre in Kollam. However, it soon became apparent that the centre lacked the necessary amenities to accommodate female detainees. Faced with this challenging situation, the jurisdictional magistrate court permitted the women's relocation to Gandhi Bhavan in Pathanapuram, Kollam district.
Regrettably, this transfer was met with opposition from the central government, which argued that Gandhi Bhavan was not officially recognized as a detention centre. Despite an order issued by the Indian government in September 2022 mandating the establishment of a dedicated detention facility for women, no such centre has been operational to date. Consequently, Adamba and Sebina found themselves temporarily housed at the Sakhi One Stop Centre, which also lacked adequate resources to cater to their needs.
"With the permission of the jurisdictional magistrate court, both women were then transferred to Gandhi Bhavan, Pathanapuram, in Kollam district," reads a report from Times of India.
The court has directed that the women remain at Sakhi until a proper detention centre is established. In response, the Indian government has assured that it is taking steps to create transit centres specifically for Kenyan and other foreign women released on bail, with the relevant department requesting a two-month timeline to operationalize the necessary facilities.
