The US Citizenship and Immigration Services (USCIS) has increased the validity period for initial and renewal Employment Authorization Documents (EADs) for certain non-citizens to 5 years.
This includes non-citizens admitted to the US and refugees, paroled as refugees, granted asylum, as well as those who have applied for suspension of deportation or cancellation of removal.
Previously, all EADs had a maximum validity period of 3 years. USCIS says increasing the maximum validity period is intended to reduce the number of Forms I-765, Application for Employment Authorization, that the agency receives each year. This will in turn reduce associated processing times and backlogs, the agency hopes.
EADs may be terminated prior to their expiration date such as in cases where the underlying adjustment of status is denied. For example, an individual who applied for and received an EAD as part of adjusting their status through marriage may have their EAD revoked before its expiration date if the application of adjustment of status through marriage is denied.
