Foreign Governments Warn Citizens About Unpredictable US Entry Procedures

As peak travel season approaches, international travellers and lawful permanent residents face growing challenges entering the United States, prompting advisories from several foreign governments and caution from legal experts. 

Concerns are mounting over intensified inspections and stricter enforcement by US Customs and Border Protection (CBP) at airports and land entry points. Governments including Canada, Ireland, Denmark, and Germany have issued updated advisories urging their citizens to meticulously adhere to US entry requirements to mitigate the risk of complications or detentions. These advisories reflect shared concern about the unpredictable nature of border inspections, which have already disrupted travel plans for numerous individuals.

The increased scrutiny stems from immigration enforcement practices that began under the Trump administration and have persisted. Reports indicate lawful permanent residents have faced detainment and extended questioning, prompting institutions such as Brown University to advise international students and staff to exercise caution and minimize non-essential travel.

Legal experts emphasize the need for travellers to be well-informed about their rights and immigration status before attempting entry. While US citizens possess unequivocal protection against denial of entry, green card holders may encounter challenges, especially with prior criminal convictions or extensive travel histories. Both groups have the legal right to decline CBP agents' requests to inspect digital devices, although this may result in delays. 

Visa holders refusing device inspections risk outright denial of entry. The intensity of scrutiny varies based on travellers' nationality, visa type, and legal records. Citizens from countries including Iran, Libya, Afghanistan, Venezuela, and Cuba may face additional travel restrictions. Visa holders from these regions risk secondary inspections, temporary detention, or forced return flights despite possessing valid documentation. Green card holders may also face difficulties after extended periods abroad or in cases involving minor legal infractions.

The search for electronic devices during inspections has emerged as another significant issue. CBP agents are authorized to review digital content for potential security threats, criminal affiliations, or visa-related discrepancies. While travellers can request agents' identification and receipts for confiscated items, the process often remains uncertain. In the event of entry denial or delays, immigration attorneys stress the importance of remaining calm and seeking immediate assistance. 

Non-English-speaking travellers have the right to request interpreters during questioning, and experts advise documenting such requests formally as part of protecting legal rights. As summer travel intensifies, green card holders and visa applicants are advised to approach international travel cautiously.
