Attorney LaToya McBean Pompy notes that many immigrants who were previously unafraid are now worried about their futures due to heightened scrutiny and enforcement activities. The Immigration and Nationality Act's provisions have been used to scrutinise green card holders, particularly those perceived as threats to national security or foreign policy. The arrest of Mahmoud Khalil, a case that garnered significant attention, highlighted the vulnerabilities of lawful permanent residents.
Attorney David Leopold points out that even accusations, especially those involving certain crimes, can lead to detention for immigrants. Pompy connects this anxiety to the increased visibility of Immigration and Customs Enforcement (ICE) actions, often shared online, which amplify concerns within immigrant communities. Vice President JD Vance further fueled uncertainty by emphasising that green card holders have limited rights compared to American citizens.
Vance stated that the administration has the authority to decide who is suitable to remain in the country, suggesting that the Secretary of State and the President can revoke a green card if deemed necessary. Legal experts advise green card holders to exercise caution when travelling internationally, recommending they avoid prolonged absences and seek legal counsel before travelling. Attorney Charles Kuck reassures that most green card holders should not face problems unless they engage in activities considered threatening.
Homeland Security Department spokeswoman Tricia McLaughlin defends the administration's approach, stating that they are enforcing immigration laws that previous administrations had neglected. She emphasises that individuals who violate these laws will be processed, detained, and removed as required.
