Babu Owino Appeals His Election Nullification

Embakasi East Member of Babu Owino has filed a notice of appeal at the Appellate Court seeking to challenge last week High Court ruling that nullified his election.
In his notice, the embattled youthful MP says he was not satisfied with the decision made by Justice Joseph Seregon after a petition filed by his opponent Francis Mureithi of Jubilee party.
In his ruling on March 2nd, Judge Seregon held that the Embakasi East Parliamentary election was not free and fair and directed Independent Electoral and Boundaries Commission (IEBC) to conduct a a fresh poll in accordance with the law.
"It is clear that the election is not verifiable due to the irregularities," Justice Sergon said.
Sergon further ordered Babu and the electoral commission to pay Mureithi Sh2.5 million each as cost.
The court said that it established that Owino coerced and intimidated the Constituency Returning Officer, which compromised the credibility of the poll.
After the court ordered for a recount and scrutiny of votes, Babu Owino garnered 46,817 votes against Mureithi's 42,501 votes; each of them recording a slight increase compared to result announced after August 8th,2017 election.
