Man to pay Sh500,000 Fine for Insensitive HIV Remarks

A recent ruling by the HIV and AIDS Tribunal in Kenya underscores the significance of safeguarding the privacy of individuals with HIV.

This case arose from a dispute between neighbours over the construction of a pit latrine. The defendant's actions, including insults referencing the plaintiff's HIV status, have resulted in a substantial financial penalty and an order to dismantle the offending structure. The dispute arose when the plaintiff, who hosted self-help group meetings, discovered her neighbour constructing a pit latrine adjacent to her home.

The construction caused dust and disruption, prompting the plaintiff to request its cessation. In response, the defendant not only refused to stop but also made a discriminatory remark, suggesting the plaintiff would succumb to HIV/AIDS. This verbal altercation escalated, leading the plaintiff to seek recourse through the Tribunal. The plaintiff presented her case, detailing the psychological distress caused by the defendant's stigmatizing comment and the health risk posed by the open pit latrine, particularly given her weakened immune system.

The Tribunal presided over by Carolyne Mboku, found the plaintiff's claims compelling and issued a ruling in her favour. According to the tribunal's decision, the defendant's disclosure of the plaintiff's HIV status without her consent constituted a clear violation of her right to privacy as enshrined in the HIV and AIDS Prevention and Control Act. Secondly, the Tribunal recognized the potential for psychological harm caused by such stigmatizing remarks. Finally, the open pit latrine was deemed a health hazard, especially for individuals living with HIV.

The Tribunal's verdict has ordered the defendant to pay the plaintiff Sh 500,000 as compensation for the unlawful disclosure of her health status. Additionally, the Tribunal mandates the demolition of the pit latrine, citing its detrimental impact on the plaintiff's health and the potential for wider environmental hazards.
