Senators Murkomen, Susan Kihika Move to High Court to Challenge 'Illegal' Removal

Senators Kipchumba Murkomen (Elgeyo-Marakwet) and Susan Kihika (Nakuru) have moved to court to challenge their removal as Senate Majority Leader and Majority Whip respectively.

Murkomen and Kihika were stripped of their positions following a Parliamentary Group meeting held at State House, Nairobi on Monday.

In a case filed under certificate of urgency at the High Court, the two have named Registrar of Political Parties Ann Nderitu, Senate Speaker Ken Lusaka, Jubilee party secretary-general Raphael Tuju and Kanu’s chairman Nelson Dzuya as respondents.

They claim the respondents flouted the law by signing an illegal post-election agreement that culminated in their removal as Senate Majority Leader and Whip.

“The respondents have in blatant violation of the law engaged in an illegal coalition where after have purported with the strength of the said coalition to remove the Majority Leader and Majority Whip of the Senate in blatant disregard of lawful procedures,” court documents read.

The two further argue that the Parliamentary Group meeting held at State House lacked quorum as the number of senators who attended was not enough to kick them out.

They have asked the court to declare the post-election deal between Jubilee and Kanu as invalid, null, and void, saying it was not sanctioned by Jubilee’s National Executive Committee (NEC).

Murkomen was replaced with West Pokot Senator Samuel Poghisio of Kanu while Senator Irungu Kang’ata of Murang’a took up Kihika’s position.
 
The matter will be mentioned on Thursday, May 14th by Justice James Makau.

Your mind does not think beyond tribal lines. You first look at tribe, so as to form an opinion about an anything, instead of looking at what brought about an event, so as to form an opinion about it. So when Uhuru, a Kikuyu, boots Kihika, another Kikuyu, you are dumbfounded and speechless! There is no tribal angle to form an opinion, or attack anyone!

Jubilee owns the courts too.They are wasting their time.I guess Uhuru is saving his best card for Kuria mpig in his own backyard who all of a sudden has gone silent.All those times he was taunting Uhuru about development.Breaking news hot off the press Team tangatanga you are no longer part of the dinner party but is on the menu.Mtasakwa na kumalizwa wote.One by one or two by two in the case of Cattle Dip chairman murkomameno and madam Kihika.

Kuria is a scare crow who talks without using his brain; if at all he has any. I would be the first one to cast a vote to recall the useless guy! He needs to be fired in a more dramatic and uglier way than Murkomen and Kihika!

Then move forward to eject the mad kid with a foolish name called Didi. Go across to Kandara and get rid of Wahome. Then on to Gitau, Ichungwa, and then move on to Kimani Ngunjiri of Bahati. The axe shouldn’t stop until DP Ruto is impeached and jailed. These childish leaders must be fired! They are the known thieves of our money.

The courts can be ignored should they try to side with these useless senators and MPs. It would be a good time to revisit Maraga issue and eject him from the Chief Justice seat should he act stupid. The judiciary are the most corrupt of all the arms of government. That is where Ruto spends all the stolen billions bribing sitting judges to rule in his favor.

The courts have made life unbearable for all Kenyans. They should al be fired along with their corrupt politicians. We need to reclaim our country back to the people!

The house cleansing must continue until all the rogue politicians and civil servants are completed routed out. We the people want them gone so our government can start functioning. These folks have been a road block to development. They have failed us, the people!

They have stolen everything led by Ruto himself hence forcing the government to keep on borrowing. It is time to clean the house!!

Let the axing continue without any mercy!

You can’t be that foolish to destroy everything you’have in one day! Step aside and make a good scrutiny of Ruto, the man you have fallen heads over heels for and just ask yourself! Is he worth all your troubles??

They all wonder how Murkomen could stoop this low below the belt to take shs 400,000 away from his wife and children.

Way to go. Seek leverage and challenge the dynasties in all levels.This is unconstitutional and undemocratic. Everyone has freedom to choose whom they support. After all, you were democratically elected in your respective political seats. Nothing was dished out to you like candies. Go seek the leverage in the other arm of Govt!
