The High Court has issued an order barring Lieutenant General Mohamed Badi from attending any cabinet meetings.
In a ruling on Thursday, High Court Justice Anthony Mrima also prohibited Badi, who is the director-general of the Nairobi Metropolitan Services (NMS), from discharging any functions of the cabinet.
Judge Mrima quashed a decision by President Kenyatta that appointed and included Badi into cabinet meetings.
He declared the decision contained in Executive Order No. 3 of 2020 as illegal, null and void.
The ruling followed a case filed by Kandara MP Alice Wahome, who was challenging the constitutionality of the decision to appoint and include Badi into the cabinet and its committees.
In September last year, Badi took Oath of Secrecy, a requirement of all persons who attend Cabinet Meetings or participate in the conduct of Cabinet Business.
The ceremony conducted by the Head of Public Service Joseph Kinyua at State House, Nairobi was witnessed by President Kenyatta.
Kenyatta appointed Badi as the director-general of NMS in March 2020 to run the six Nairobi County functions handed over to the national government by former Governor Mike Sonko.
The functions include county health services, transport, public works, utilities, and ancillary services, and county government planning and development.

The high court judge errored in his judgment and therefore his decision is null and void!
Uhuru can appoint whomever he thinks is fit to run the city of Nairobi or any other city in Kenya! So Badi need to continue working as usual without any interruption! What is the judge gonna do? Utterly nothing!!
So this judge wants the corrupt Sonko to come back and destroy the county of Nairobi even more? These judges need to get some ass whipping to shape them up! They always seem to work against the wishes of the common wananchi!
Mike
Just to correct your understanding here.
The judge has no problem with Badi running the county affairs it's only sitting as a cabinet secretary meeting that has an issues.
And to correct your understanding, sitting in cabinet meetings is the only time and place General Badi briefs the president!
These fake judges are porking their dirty nose in matters of less concern to them! I would not obey such a myopic order if I were the president!!
The courts will now be deciding who the president can/cannot meet. Only that these are the same courts that have delayed corruption cases, from those of Kidero, Waititu, to Sonko and many more. They have no time for these cases, but they have time to maintain State house agenda.
Nairobi county needs to do it job.
NMS is behaving the way Mungiki used to behave before they started attacking people in Nairobi.
