Miguna Miguna Sues Lufthansa Airlines, Air France After Failed Trip to Kenya
Kenyan-Canadian lawyer Miguna Miguna has sued Lufthansa Airlines and Air France following his failed trip to Kenya last month.
In an application filed under a certificate of urgency at the Milimani Law Courts on Friday, Miguna asks the court to issue an order compelling the two airlines to fly him to the jurisdiction of the court within 48 hours ahead of the hearing of the application.
Miguna, who filed the application through his lawyer John Khaminwa, further wants the court to bar the two airlines from flying to Kenya if they fail to transport him to the jurisdiction of the court in Kenya. In addition, Miguna asks the court to bar the government of Kenya from issuing red alerts and travel advisories against him.
He also lists Kenya's Attorney-General Kihara Kariuki, Interior Cabinet Secretary Fred Matiang'i, Foreign Affairs CS Rachel Omamo and Kenya Airports Authority as respondents in the case filed in the high court constitution and human rights registry.
Miguna, a firebrand lawyer who describes himself as a National Resistance Movement (NRM) general, also wants the court to declare that the respondents’ decision to cancel his citizenship, revoke and confiscate his passport is unconstitutional, illegal and void.
"A declaration that the detaining of the petitioner without justification and informing him of the reasons of such detention, holding him communicado in deplorable and inhumane conditions, threatening him with death and physical harm, denying him food and sanitation services was a violation of petitioners rights protected by the constitution," his lawyer told the court.

Exactly!! But as a lawyer himself, I think Miguna knows this. So he is just seeking attention, to satisfy some psychological need. If Mwakilishi and the Kenyan Media stop reporting his psychiatric escapades, he will have no desire to continue with the them. This will give him a chance to concentrate on his beautiful family.

I'm not a lawyer so I need a lawyer to explain. If the action he believes caused him harm did not happen in Kenya, how can he sue in Kenya and why would he not sue for damages in Germany or France? Since airlines are free to ban people for their own reasons, won't they simply ban this loudmouth from their planes. Lastly what jurisdiction does Kenya have in Germany or France? I would guess Kenya needs German/French tourists more than the other way around. A tit for tat would only lead to economic harm for Kenya.

Miguna Miguna is a lawyer, so he knows that he can only sue Air France in France, and Lufthansa in Germany. The same Kenyan Judges who don't recognize that Kenya, and by extension Kenyan Law, has boundaries, will issue the same useless and unenforcable 'Orders'. Miguna's real chance of coming to Kenya lay in trying to get a connecting flight from Europe to Nairobi with KQ, because they are a Kenyan Company, which has to obey Kenyan Court Orders. Foreigners don't have to. They don't even want to know about them. I never heard that Miguna tried, but was refused to board a KQ flight from Europe to Nairobi. He deliberately went where he knew that he had little chance of succeeding, but high success of drama. And he is using the same logic now. My take? Miguna has a personality disorder, whose food and fuel is Media attention. From the pictures he posted Online, he also has a beautiful family. If the Media stopped giving him attention, who knows? He may actually be able to negotiate Bride Price...

I'm still waiting for evidence that he had left Toronto in the first place. Given the Emirates flight, I doubt any flight will allow him out of Canada. They would likely insist on holding his passport till he gets to final destination.

... We are letting 'Migunaism' to RIP. We live in a Global Community, from Sars, to Conoravirus. You can only contain a peculiar disease by detaining it at the point of Origin. Miguna should stay in Canada, before we determine exactly what Virus he is, and whether he should be allowed back into Kenya. Ps... Kenyan Judges have no Jurisdiction about anything that happens outside the borders of Kenya.
