Court Hands Governor Anne Waiguru Victory against Raila

National Super Alliance (NASA) leader Raila Odinga has lost bid to have a lifestyle audit carried out on Kirinyaga Governor Anne Waiguru.

Raila had made an application for an audit of the former Devolution Cabinet Secretary's lifestyle in a suit where Waiguru has sued him for defamation. Waiguru sued Odinga for linking her to the theft of millions of shillings belonging to the National Youth Service (NYS) while she served as the CS for devolution.

However, on Tuesday High Court judge Justice Joseph Sergon dismissed the application by Raila. Sergon ruled that though Ms Waiguru did not answer a number of questions raised by Mr Odinga’s lawyer relating to her lifestyle, she gave substantive reasons for not answering.

“I am satisfied that Ms Waiguru responded to the interrogatories in accordance with the law,” Justice Sergon said.

Through his lawyer, Raila wanted Waiguru to disclose her salary, allowances, list of properties owned, and material worth, but in objection, Waiguru said the questions were unnecessary and unreasonable.

Raila had argued that a lifestyle audit on Waiguru would enable him defend himself against the defamation suit. Waiguru has also sued former senators Boni Khalwale (Kakamega) and Johnson Muthama (Machakos) for linking her to loss of Sh791 million at NYS.
