Senators Vote to Impeach Kiambu Governor Ferdinand Waititu

The Senate on Wednesday evening voted to impeach Kiambu Governor Ferdinand Waititu following a two-day hearing.
Senators voted to impeach Governor Waititu on three charges namely; a gross violation of the Constitution and public finance management act, crimes under the national law and gross misconduct/abuse of office.
In the first count of violating the Constitution, 27 Senators voted in favor while 12 voted against. In the second count, which the governor was accused of violating national laws, 28 senators voted for his removal while 11 opposed.
The same voting pattern was repeated on the third count of gross misconduct/abuse of office.
The motion for Waititu’s impeachment required a simple majority of 24 Senators to go through. The proceedings against Governor Waititu were heard by the Senate plenary for two days where he pleaded not guilty to all the charges.
In his defense, Governor Waititu blamed his impeachment by the County Assembly on people he termed as Kiambu propagandists.
“Listen to the facts and evidence but not propaganda. Kiambu is known for serious propagandists. That is the nature of Kiambu,” Waititu told the Senate.
Waititu claimed that the impeachment motion, which was first approved by the County Assembly on December 19th last year, did not meet the threshold. He alleged that only 57 MCAs out of the required 62 were present when the county assembly voted to impeach him.
Waititu was accused of gross misconduct, abuse of office and flouting the public procurement and disposal act by influencing the award of contracts to companies associated with his immediate family and close relatives.
He also faced another count of violating the constitution by forcefully dispossessing and unlawfully occupying a parcel of land in Thika belonging to Cecilia Njoki Mbugua, a widow.

What a shame! What a banana republic! I have no clue whether Waititu is innocent/guilty.But what we are witnessing in Kenya is total break-up of rule of law and rule of the jungle in its place.First , Waititu comes from/nay he is the president's governor- he comes from the presidents party/nay former party since he defected to the "opposition".The president is totally behind the stupid antics of getting the governor out- no problem with that but for heavens sake have the pair to speak up- courage to tell your county that you need change. That the governor is being removed from office by majority vote of the "opposition" to your party is chilling.By this vote in the senate the country must be a very worried one.Does it mean that by BBI every governor will serve at the mercy of the two "entitled princes?". Waititu is out of office via a court order over exactly the same issues. Pray what happens were the courts to rule that he is "innocent?"Does he get back to office? Why not wait for the courts to run their cycle? What harm is he causing out of office? the now chest thumping uhuru was elected while attending ICC cases of worse charge than the governor. I and most people argued on this generous platform that it was not fair to bar him and ruto from running for office unless they were found guilty. We were right and that is the argument the lawyers used. uhuru has forgotten all that and would rather use stupid impeachment process rather than wait for the courts. What a shame! Besides why would the party not meet and "persuade a recall of Waititu/Sonko" to save the country from the nonsense that we are being treated to? Simple- we have a president who has defected from his party/taken leave from common sense/exhibit traits of a confused/drunken approach to governance and acts like a cut-off tail of a jagathi not realizing that the actual lizard left long time ago.Mr. president you are alone in your nonsense. You are a mkia whose jagathi left behind- soon you will not wag the tail it will dry up.

You have some beef with Uhuru and rightly so but in this case the Senate made its own independent decision. This is a wonderful step towards the right direction and I commend the Senate. Call Sonko next please.

@francis - are you confused about what it means to have corrupt leaders vs corruption itself?
Are you telling Kenyans that corrupt leaders belonging to the same party with the sitting president should not be prosecuted and must claim executive privileges ( be immune to prosecution) when they steal from the citizens of Kenya, mainly the poor?
Are you aware how much money Waititu, Sonko, Kuria, Kiunjuri, and many other politicians have been accused of blatantly embezzling?
Do you know who is mostly affected by corruption, stealing from the coffers by politicians and civil servants - eg - Rotich, Thegu, Sonko, Waititu, etc. - who is directly affected most? Does ordinary tax payers mean something to you? What does, “ordinary Kenyans” mean to you? Jubilee Party politicians and members or all Kenyans?? “We the people” - what does that mean to you?
Have you ever heard of embezzled funds meant to build Arrow and Kimwerer dams in Sugoi, better yet Elgeyomarakweti!? Who lost in this compromised venture involving Kshs 22 billion plus Kshs 64 billion that are yet to be accounted for?
MP Kuria allocated over Kshs 100,000,000.00 of the CDF money to his own brother to build four classrooms - really? Classrooms made of gold, or money misappropriated to enrich Kuria and his family? Do we have to consult a ”HUDINI” to tell us the truth here?
Former CS Kiunjuri who was recently fired for poor performance, and general ineffectiveness as a CS left with Kshs 2 billion he stole from the maize kitty. Should this money be ignored or should Kiunjuri pay back the money he embezzled?
Kiunjuri has now formed a new party after 25 years of blunders in politics, so he can continue cheating ordinary citizens. Is this man capable of service Kenyans any longer?
Now, you have said Uhuru this and Uhuru that to justify your love for the thieves and the most corrupt politicians eimoly because they belong to your Jubilee party! Are you saying the thieves should be protected by the president at the expense of the tax payers?
In your own capacity as a Kenyan, if indeed you are a Kenyan, do you expect Uhuru to keep mum as the country go to HELL through conspicuous theft and mismanagement of our diverse resources? what does corruption mean to you?
The Kenyan people, you included are the direct victims of what Waititu, Sonko, Kuria, Kiunjuri, etc have done! They have all stolen from women, children, young kids who can’t afford school fees, disabled members of the society, deaf, weak men, etc and all the future generations!
Are you a weak man to a point you see no evil, hear no evil, and will just settle for corruption as a way of life in Kenya simply because you are weak??
Are you proud of the damage these thieves have done to a country that you dearly love; that we all dearly love???
May you see the light just like Saul did on the road to Damascus! And yes, Damascus is in the present Syria!

@ Maina, kindly learn to read and comprehend before regurgitating useless stuff about corruption and who is corrupt based on gossips and bar stories.Only a competent court of law can determine guilt or innocence of an individual NO EXCEPTION.That is what a democracy does.At no point did i advocate that corrupt persons get a pass- i argue the opposite- that courts deal with them.I am shocked that you say i argue that waititu get a pass because he is from the president party- far from it! My point is that since the president comes from this county- he owes the country the duty of talking to the county leadership and give guidance as a senior county citizen to save the county from ridicule and lack of service/order.This mob justice mentality of calling people corrupt just because you do not agree with them is shallow and reserve for morons.People are not corrupt just because you say so no matter how "intelligent" you may be.I challenged you before- is wako corrupt? The US thinks so! He voted to remove the governor??? Waiguru was hounded out of office because of corruption- she is now a governor- should she be removed? Ngilu was sacked by uhuru because of corruption?? she is a governor- when was she acquitted? Bottom line- i defended them then and will do so today- that is fairness. As a patriotic citizen observe below you have a governor accused of killing an innocent young girl and her un-born baby but he presides over the county? But he is innocent until the courts say otherwise- that is the law.So spare the lectures about corruption and direct them elsewhere. How much money has been recovered so far? That is what we need- restitution upon conviction.Using propaganda and juvenile antics to get people out of office is corruption.I guarantee you that should the courts not undo the stupid/garbage impeachment by the senate-the deputy governor will have a very hard time "ruling by force".He will be kicked out come next election and will be rejected as he had when he ran solo- take that to the bank.People are not stupid!

A very good precedence in rooting out corruption, and all the other corrupt politicians! Kicking the thieves out office is the only way to maintain checks and balance in the system.
When is Waititu departing the people’s county office?
No one is above the law!

Meanwhile...an MP shot someone twice on camera and is walking free on attempted murder charges and still has a job.... Gov Obado still has a job.... Sonko is out of a job for stealing funds ....Sarah Cohen is still free ...conclusion is that..it's easier to get away with murder than to steal money. Money over life. Kenya really has it backwards.

I have no doubt that Waititu deserves to be kicked out of Office. That he actually stole a Widow's piece of land simply because he could means that he actually belongs in jail. But if I remember well, we have a Supreme Court in Kenya which ruled in 2017 that the process is more important than numbers. So if it true that the MCAs who Impeached Waititu did not have a quorum, I will wait to see whether the Courts will 'nullify' the Impeachment on a technicality, and ignore his Crimes.
