Nairobi Businesswoman Ordered to Surrender 5 Buses, Sh1.7 Million to Govt over Drugs Link

A Nairobi court has directed a businesswoman to surrender all her assets to the government over links to drug trafficking.

Rose Momanyi, a business lady based in Nairobi, will lose assets worth millions of shillings following the order issued on Monday by High Court judge Mumbi Ngugi.

Justice Mumbi noted that the Assets Recovery Agency (ARA) has a prima facie case against her, adding that the court treats the assets as proceeds of crime since she failed to explain the sources of her wealth.

As a result, she is required to forfeit to the State a fleet of five buses, a saloon car, and Sh1.7 million held in two accounts at Sidian Bank and Diamond Trust Bank.

Momanyi was arrested at her home in Kinoo on June 14th, 2019, with detectives recovering 796 grams of heroin from the house. She was later charged with trafficking narcotics. 

She is said to have used two proxies, Thomas Kunduti and Margaret Mugo, in registering her vehicles. Justice Mumbi found inconsistencies in Mugo and Momanyi's statements with the former indicating that the latter sold her one of the vehicles for Sh2.7 million while the other quoted Sh3.1 million.

“Perhaps Momanyi was attempting to use Thomas and Mugo to conceal her assets but given the obvious contradictions and disparities in their averments, it is clearly not a well-thought-out ploy,” said Justice Mumbi.

Momanyi deposited the Sh1.7 million in her accounts in tranches to avoid scrutiny, according to ARA.

She told the court that some of the money was from the sale of a parcel of land in Kakamega County and inherited a further Sh500,000 from her late husband. Momanyi also claimed she earned money from her matatu and second-hand clothes businesses.

But Justice Mumbi said the accused failed to provide credible documents to prove the money came from her businesses.

“She has, however, placed handwritten documents in which she avers that her matatus were often hired for long-distance journeys. There is no way of authenticating these documents,” the judge said.

Justice mumbi ngugi should replace our kiraka viraka maraca.He has failed kenyans miserably.All looters are roaming free in our midst of their deep pockets while maracah is busy chasing the beautiful skirts in sight sent to hoodwink him that they steal.

Justice ngugi is a very good example for Maraga to look in the mirror and see!

We have the wrong guy for Chief Justice! But unfortunately Maraga is a total mirror image of most members of the judiciary and a whole lot of corrupt lawyers who are tearing down our country with corruption and injustice!

Justice Mumbi is probably the only judge Kenyans can trust.
My only fear is, when they start going after KABOGO; JOHHO,MWAU, KIBAKIS KINS and all known drug dealers like Atieno and some cabinet members, she will be killed just like what happened to SAITOTI.

Justice Mumbi Ngugi is the most qualified candidate to take over as the next CJ after the current Chief Justice goes home. She is competent, transparent and dedicated Judicial Official who handles her role with a lot of integrity. She is able to handle corruption cases head on without fear or favor. She is a role model and will be remembered for many years to come!

This is a very refreshing story to the ears of Kenyans! Judge Ngugi is the positive narrative Kenyans need to hear on daily basis!

She is blatantly telling all Kenyans that criminality has got to change for Kenya to move forward! The youth is taking note on her good work!

While we desperately need her for the CJ position, she can even do better as the next president of the Republic of Kenya!

We are all tired of the “debe tupu politics” which continue to eat our beloved country away!

This judge understands Kenya more than any other citizen!
