Martha Karua to Challenge Governor Anne Waiguru's Election at Supreme Court

NARC-Kenya leader Martha Karua has announced she will move to the Supreme Court to challenge the Appeals Court ruling that upheld the election of Anne Waiguru as Kirinyaga Governor.

This comes after Thursday's Appeal Courts ruling that dismissed her appeal against Waiguru’s victory in the August 8th, 2017 elections.

“Appeal dismissed with no order as to costs.  Am headed to the Supreme Court to exhaust the justice chain,” says Karua on her Twitter account.

Karua further alludes that Governor Waiguru had prior knowledge of the Appellate Court's verdict in the case.

“For a respondent who never came to court during the hearing, but comes to court for judgment complete with a battery of media in tow and a celebration party, leaves one wondering whether she was aware of the outcome,” tweets Karua.

In their ruling, Appeals Court judges said that the appellant didn't prove beyond reasonable doubt, her claims of voter bribery in Kirinyaga gubernatorial election.

“There was no prejudice suffered by the appellant in failure by Independent Electoral and Boundaries Commission (IEBC) to produce the Kenya Integrated Election Management System (KIMS) kit,” the ruling read by Justice Gatembu Kairu reads in part.

Karua moved to the Court of Appeal after Kerugoya High Court Judge Lucy Gitari dismissed her petition challenging Waiguru's victory on grounds that it lacked merit 

Waiguru clinched the seat after garnering 153,353 votes (53 percent) while Karua came second with 116,626 votes (40.97 percent).
