I’m Not Your Father, Former Assistant Minister and MP Omingo Magara Tells Man Seeking DNA Test

A 39-year-old man has moved to court seeking to have former South Mugirango MP James Omingo Magara compelled to take a DNA test.

Justus Arunga Mauti claims to be a biological son of Magara, who served as an Assistant Minister in President Mwai Kibaki’s administration.

Through his lawyer Wilkins Ochoki, the petitioner told the court that he is seeking parental care, love, support, and the right to enjoy dignity, security, and equality like other family members of Magara.

“My client’s rights to dignity inherent in a human being, the recognition and protection of his human and legal rights have been violated by the respondent in this case. We are seeking an order compelling him to undergo a DNA test to ascertain that he is the biological father of the petitioner,” Ochoki told the court.

Arunga claims that Magara met his mother Peris Bochere Magare in the late 1970s when the two were both high school students. 

They entered into a romantic relationship that led to his birth but the two parted ways soon after and his mother got married to the late Councillor Mauti Magare, who became his foster father, while Magara pursued further studies abroad.

“I have held several meetings in the past with Omingo Magara to talk about the issue of him being my biological father and to further seek recognition as a member of his family. At no point has he ever denied being my father during our previous meetings,” Arunga told Kisii High Court judge Anthony Ndung’u.

But Magara through his lawyers told the court that he does not remember meeting Arunga’s mother or having a love relationship with her while he was in high school.

“I never had an intimate relationship with the petitioner’s mother or any other woman while in school. After high school I proceeded to India for my university education, I have known Arunga’s mother as the wife of the late councilor Mauti Magare who was a close friend,” says Magara.

Magara, who unsuccessfully vied for the Kisii Senate seat in 2013, says he is not willing to undergo a DNA test as there is no possibility of Arunga being his biological son. He added that subjecting him to DNA would be an intrusion to his privacy and integrity.

The matter will be heard on May 19th.

Mr Magara, unless you are refusing this to make yourself relevant, refusal to have a DNA test makes you look like you have something to hide. Most men will claim to never have been involved with a woman to avoid the responsibility. This young man at 39 he should be entitled to know who his father is.

The kid is 39 yrs old and should be the one providing financial support to Maharashtra because he is old now! A 39 year old kid should be self sustaining and not running around looking for help from his old father!

To know who his father is, he really need to talk to his mother. DNA is only 99.99%. If we assume a Kenyan (and neighboring Uganda) population of 15M men above 13 years, any of the 1500 men could be his dad. He need to start with his mother. If he test 500 men from his village, he will be surprised to find same DNA (read dad) in half of them.

Mr. Maraga, taking a DNA test is the least invasive medical test you could take.
According to "the son", this matter is not new.Something must have happened for Magara to distance himself.At least he does not deny having romantic relationship,he just does not remember.DNA test will settle this paternity issue for fair and square.That is barring some shenanigans such as interfering or tempering with the sample.
At 39,both parties have missed alot in the son-father relationship.That leave the question,is there another motivation.Even if there is, still DNA is required to acertain paternity.
Days of hit,and run are long gone.But more importantly,those who engage in relationships that could produce ahuman being,should also be responsible enough to acknowledge and take care of the innocent human being they create. You play you pay.
I am a man,but I can tell carrying a baby for nine months or so,changing your shape,and the general"burden" that comes with being pregnant is no meat feat and the least a man can do is not run away.Or abscond his responsibility in the matter.Just put your self in the woman's shoe.My two cents.

Seems Maraga know he is the biological father that why he does not want DNA. He does not want to be asked why he run away from responsibilities of a father.
