Gatundu South MP Moses Kuria to Table Bill Seeking to Reconstitute the Supreme Court

Gatundu South Member of Parliament Moses Kuria has vowed to table a Bill at the National Assembly, to reconstitute the Supreme Court and the transmission of election results following the nullification of President Uhuru's reelection.

Kuria, a staunch Jubilee Party supporter expressed his disappointment with the Supreme Court decision to annul the election on grounds of mode of result transmission.

Kuria said that his first business in the National Assembly once it reconvene, will be to table a Bill that proposes that a minimum of five Supreme Court judges will be required to overturn presidential election results in case of a petition.

"My first business in parliament
1. No more electronic transmission of results. We count all votes at the constituency and declare them there.

2. Supreme Court will require minimum of 5 judges to overturn results. I will easily get support of 233 members, " Kuria posted om his Facebook page.

Currently, it only requires a simple majority of the seven Supreme Court judges, to overturn a presidential election.

Kuria's bill will also amend the Electoral Act 2015 that states that election results must be transmitted electronically from polling stations to constituency and national tallying centres simultaneously.

Four Supreme Court judges including Chief Justice David Maraga, his Deputy Philomena Mwilu, Smokin Wanjala and Isaac Lenaola ruled in favor of the petition, while Njoki Ndung'u and Jackton Ojwang upheld the election. Justice Mohammed Ibrahim did not vote as he was hospitalised.

Kuria, had the IEBC been doing their job properly, they should have not cleared you to run for any elective public office. You belong to Mathare mental hospital.

It is interesting that the learned Judges see the same evidence,and come to different conclusion.
Why majority of 5? There are only 7 supreme court judges why not have not have all of them agreeing on the critical issues such as overturning the presidential election results?

@max.In my opinion.If we are going to have live with an activist supreme court bench.We have to make it almost impossible for them to over rule the will of the people.having all of them have to make a unanimous decision in order to over rule the will of the ordinary mwananchi is the right thing to do.if this kind of Bill can be passed,then parliament should do it as soon as possible.

GG, if you have same facts why shouldn't the answer be the same?Unless one or two are interpreting the laws wrongly.My point is,courts speak with a great authority when they proffer a unanimous voice.
Yes Iam aware of the dissenting opinions which undoubtely will exist when different interpretation of the law is applied.However, there is not reason for mere dissent just for the sake of arguing.Given this view,you can see how all judges could on a particular case be unanimous...

table a bill then to change the constitution and election laws. The same uhuruto reviewed the constitution before it enacted and approved the same laws that have come to bite them. You don't simply change the constitution to serve you, but the serve the best interest of the entire nation and ensure elections if fair and valid. Why are you guys mad at the wrong people? If IEBC had done their job without being corrupted by some 2 political figures, the supreme court would have tossed the case out of the court for lack of evidence.

The judiciary must be reconstituted in order to strike a balance. Presently, the judiciary is pro-opposition. Opposition has not lost a single case they have filed so far. Even better, we should have a referendum for judiciary change with a Yes, No together with the presidential vote.

@Mwose, I am neither a Luo, Kalenjin, Luyia. Kamba, or Kikuyu. Many inappropriate things have been done to the Luo's by our arrogant Kalenjin and Kikuyu.

The Kikuyu took an oath that they will not be ruled by an uncircumcised person ( Kihii). My ethnic group circumcises men. However, I can't impose my cultural practices to anyone. This circumcision issue is at the root cause of Kikuyu people refusing to allow a Luo be the head state. Criminal Kuria has repeatedly talked about Raila's circumcision issue.

Good question: HOW CAN A BUNCH OF JUDGES WHO WENT TO THE SO-CALLED KENYA SCHOOL O FLAW RECEIVE THE SAME EVIDENCE AND COME UP WITH DIFFERENT VERDICTS?? Nairobi law school needs to be turned into a poultry house instead. I think a bunch of chicken squawking around would have come up with a better verdict.
On a follow-up: These fires that broke out in several schools located in NASA strongholds the night after they won the election were a way of blood sacrifices to appease the demons that directed Maraga to annul the polls. How can 4 schools burn in one night in different parts of the country right after Raila wins in court?????????? And for the FIRST TIME even Maraga goes to a disaster site to "console" the victims. Where else did Maraga go when there was a disaster before? He was going to bow to demons at the sacrifice sites. Kenyan Christians (not just religious fakes like Maraga) need to pray and fast for the country. Uhuru also should not have allowed "Kikuyu elders" cum herbalists to "pray" at his home. Those are not prayers but curses that the herbalists put on him. That is why the victory was snatched from him but with repentance and prayers he will win a second time. Uhuru don't allow witches to do rituals in your home again under the pretext of prayers. Herbalists are not Christians. Ruto you should know that

One more thing, Moses with due respect where are you getting this number 5 from? Strategy is more important than numbers. This is a wake-up call, go do your homework, get a strategy that will work in our favor no matter who is in the SC and all the other independent institutions. There is something called apportionment and "fair" division-invest there.
