Machakos Governor Alfred Mutua Wins Petition Challenging His Election

Machakos governor Alfred Mutua has won a court case challenging his election as governor.

Justice Aggrey Muchelule of the Machakos High Court on Friday struck out the petition filed by Wanyiva Ndeti, saying she did not provide sufficient evidence in court to prove that Mutua stole the elections.

"I find that the case was not proved beyond doubt... the allegations are not established and lack merit…The elections were free and fair”  Justice Muchelule said in his verdict.

In her petition, Wanyiva also claimed that her agents in over 300 polling stations were denied access and were not allowed to go through forms 37A. Judge Muchelule however said Ndeti did not provide the said agents to testify in court, saying: "I find that without recording of statements by these agents, this claim by the petitioner is not materially sufficient.”

Mutua, who ran on a Maendeleo Chap Chap ticket, garnered 238,405 votes in the August 7th, 2017 general elections to secure a second term as governor, against Wanyiva Ndeti who garnered 199,257 votes. She ran on a Wiper Democratic Party ticket.
