Kenyan Businesswoman Returns from the US After 12 Years to Vie for Tetu MP Seat

After living in the United States for 12 years, Mary Muthoni Wachira has returned to Kenya seeking to represent Tetu Constituency in the National Assembly.

Muthoni, who is eyeing the parliamentary seat on a PNU ticket in the August 9th general elections, believes it is time to bring the expertise she has gained abroad to change the lives of Tetu residents.

“I first travelled to the United States to find out why businesses were failing in Kenya. What is in the US that is not in Kenya? What can be done for every family to take every child to school without struggle? Do we have to leave the country to make it?” Muthoni posed during an interview with Nation.

Muthoni, who heads the Kenya Diaspora Forum, has placed improving education, healthcare, business and agricultural production at the top of her agenda for Tetu constituency if she is elected as the new area MP.

The businesswoman promises to use the knowledge she has gained in the US and other parts of the world to transform the constituency. She says her job of taking care of a governor’s wife in Washington for five years, before working for another governor and later on for a senator has improved her understanding of how to deal with many problems.

“I have learnt from the best in a country where systems work, where you cannot fight, cheat or remove the system. If you are removed from the system, be it for a driving offence or credit, you have to work very hard to get back into the system. Here, people manipulate the system or remove the system because corruption is widespread,” she adds.

To advance education in Tetu, the MP aspirant has pledged to provide scholarships, build a first-world library and provide free internet for children to be connected to the tools they need to access quality education.

On healthcare, Muthoni plans to set up a chronic diseases centre to address many underlying diseases that afflict locals as well as a dialysis centre to facilitate timely diagnosis and treatment of cancer.

“There is no level 3, or even 4, hospital in Tetu. We have dispensaries. In fact, we had areas where Covid-19 cases were high because of the underlying conditions that many people suffer from,” she says.

“I am in the health sector in the United States and I am able to mobilise volunteers to help set up a quality healthcare system and provide and expand access to affordable and quality healthcare.”

Muthoni holds a diploma in marketing, a nursing degree from a community college in the US, and a degree in business management. She has also undertaken a series of courses in mental health and psychology.

“There is a lot of money in the United States and no one is asking for it, these are resources that can help transform our societies. We need to stop looking at the dollars they [Kenyans in diaspora] are remitting and focus on the intellectual resources they have to offer with their experience of having worked in most advanced, efficient systems in the world. The diaspora population is more than four million, brilliant minds with a lot to offer, but they do not know where to start,” Muthoni states.

The main reason kenya does not make progress is the simple facts that our systems are highly compromised with corruption which is eating every aspect of our development goals.

Kenyans tend to cherish those who have stolen from them and then turn around to dispense a little amount of their corrupt wealth to the poor people during campaign season. No one should ever vote for a corrupt candidate just because he bribed you for your vote.

Shs 1000 issued in public rallies should be condemned because it makes people dependent of those politicians who reduce the citizens to nothing. Its high time corruption is rooted out of the kenyan systems.

I saw Oscar Sudi bribing voters to attend Ruto’s rallies. No body should go to a rally because bribes are being given. Those bribing Kenyans in political rallies are not fit to lead. They will compromise everything once they get to power.

The art of collusion of Kenya women against men is a huge business in Kenya. Muthoni’s fake allegations about her husband causes me to recall another woman called Catherine (Kate) Muthoni Mwaura. Her home is between Kutus and Embu, and she was a music teacher at Pangani High School and Starehe Boys on different occasions. This lady Muthoni had an appetite for women. She dated women. Back in 2006 she met a rich Kenyan guy who lived in Norway. She wanted to move to Europe purposely to further her own interests. And here now she had found a golden opportunity to relocate using this guy. She lied to the guy that she was straight and she was ready for marriage. They both married very quickly and the guy paid for every expense to move Kate to Norway. When she got there, she started searching for women to date. When the guy found out, problems started in the very first year of marriage. The guy filed for divorce even before one year was over; but now Kate wanted 1/2 of this guy’s wealth. She started lying to the Norwegian government that she is being abused, etc. She filed to seek asylum to stay in Norway on the pretext that she was an abused woman so that she can get Norwegian citizenship using that line of lies. The bad thing about all this her parents back in Kenya supported her conwoman-ship instead of advising her properly. They all knew she was taking advantage of that guy. Kate’s brother Paddy Mwaura knew everything but he did not help the man who was getting conned. All the parents wanted was to brag their daughter is in Norway regardless of the way she had lied and treated that guy. She had another sister in America but they never got a long because of her lies. So, here now come another Muthoni taking on her husband to get asylum in America. People like these two women should be removed from the society and jailed for conning men and lying to the system. They use men, dump them, try to get rich of the wealth some man had sweated for, and then go on to lie to the system. This is very strange for me to hear about all over again.

The gentleman was a member of my church in Stervanger, Norway. My friend and I met him in 2005/6, immediately he had moved from the US to work for NATO in Norway. He was the only Kenyan working in NATO, a very nice and elegant place to work. As a matter of fact, he was one of the very few blacks working in NATO.

He was a very cheerful, elegant, intelligent and a respectable guy. He used to throw huge clean parties at his house and he would invite a lot of us from the church to come hang out talk and party. As we got to interact more with him in our Church, my lady friend started getting interested in him.

She was mesmerized by the way he nicely dressed, his intelligent conversations, his house was clean and immaculate, she liked that he never consumed alcoholic beverages, very nice unique car I think the only type in Norway, etc. So my friend really secretly fell in love with him because he had so much going on for him and he was very kind, nice, and open.

Sometimes in late 2006, my friend expressed her feelings for him in my presence. She was literally shaking and sweating profusely. But he honestly told her that he had met a lady back in Kenya and they were planning to get married. Oh, she was devastated but she respected his honesty and we all continued being friends. So we kept joking around with him but he would nicely brush the jokes off.

When Kate joined the him in Norway in 2007 or there about, the gentleman introduced us to Kate as hus wife. He was proud of her. He tokd us she used to be a High School teacher in Nairobi, Kenya; that she taught music. As women, we both felt nervous about Kate. She looked like a shady character. I personally could tell she was hiding something and she was up to no good. The parties stopped immediately she came. Kate seemed very insecure. Should kind of act funny around us.

Shortly I started to get to know Kate, but I could tell she was up to something more than the marriage. It didn't take long for Kate to start gossiping about the new husband, and we all got concerned because she talked more about the material part (money) of her marriage than the new husband. A few months later, Kate confided to me that she had a sister called Wanjiru Mwaura living in Minneapolis Minnesota and her goal was to use the guy to get to Minnesota and America. I was truly devastated for the guy.

We also noticed Kate was an alcoholic but we knew the guy never drunk alcohol. She would come to church smelling alcohol in her breathe. Months down the road, the gentleman confided to me that the new marriage was not working because Kate was a drunk and she was cheating when the guy went to work.

Almost close to a year the new marriage collapsed. He filed for divorce and Kate started seeking for asylum in Norway by fabricating lies and she started going after the guy’s wealth. At some point Kate was getting deported back to Kenya by the Norwegian authorities. Kate was such a liar who never knew to tell the truth.

At this time, Kate found a new male victim. she started dating an old Norwegian man so she could stay in Norway. Kate was nothing more than a gold digger.

So Kenyan men abroad should be very careful going back to Kenya to look for women there. Things have changed and women there have lost the moral character just like any other place in the world.

Needless to say our gentlemen friend was really happy when the divorce was finalized. Kate did not get the guy’s money because she had signed a prenuptial agreement. And out friend moved back to the US and on with his life.

Wow, what a sad story it is! I know several kenyan who have conned kenyan men in the diaspora. They all have something in common - a bunch of lies and greed for money! The really sad thing about all this, are the crude methods these women use to destroy the guys. At least this guy in Norway was very lucky to get a quick divorce and move on with his life. I am Kari and this story here was brought to my attention by my good friend of mine, Phyllis. We read it many times, and we concluded it was you Mr J. As I read it closely, I could not help not to shed sorrowful tears because I knew the couple as well. Kate tricked our good friend, Mr J into a fake marriage. The marriage lasted less than one year. This evil woman used our friend to move to Norway. Kate was never interested in a lasting marriage. And based on what I got to know after they separated, Kate just wanted a free ticket to get a US citizenship because M J was a US citizen. When the marriage fell apart, Mr J kindly asked me to find him a good Norwegian divorce lawyer because J did not speak the Norwegian language so he could file for divorce. I introduced him to a top divorce lawyer in Norway who worked his divorce with urgency and the marriage was dissolved quickly. Kate was even refusing to sign the divorce papers as she hoped to continue receiving support from Mr J. I know this because I accompanied Mr J to a divorce court many times to help interpret the Norwegian language. Sadly Mr J as we used to call him spent a lot of money to divorce Kate. But he was vigorously determined to divorce her irrespective of the huge sums if money he had spent on her. This women later went on to scamming elderly Norwegian men. As a mater of fact, Kate lied and joined the Stavanger Gospel Company, a Norwegian gospel music team in Rogaland County of Norway but that fell through. She was doing anything and everything to stay in our country of Norway after Mr J divorced her. Kate is a compulsive liar; and she lied a lot in everything. And to Mr J wherever you are in the world today, I still feel sad when I think about the unnecessary pain you went through. I still live in Sola, Norway by the International Airport. I always remember you Whenever I drive by your huge beautiful house by the North Sea. It reminds me of your gentle kindness and the many parties you invited several of our church friends. Phyllis and I are still friends if you do remember us. I really fell in love with you J although the time was not right for both of us. Petitioner Mary Muthoni Wachira, a native and citizen of Kenya, petitions for review of the Board of Immigration Appeals ("BIA") Order dismissing her appeal of the denial of her claim for asylum. We have jurisdiction under section 242(a)(1) of the Immigration and Nationality Act ("INA"), 8 U.S.C. § 1252(a)(1). We review the agency's findings of fact under a substantial evidence standard, and under this standard the agency's findings "are conclusive unless any reasonable adjudicator would be compelled to conclude to the contrary." Ren v. Holder, 648 F.3d 1079, 1083 (9th Cir. 2011) (quoting 8 U.S.C. § 1252(b)(4)(B)). We review de novo the agency's determinations of purely legal questions. Ali v. Holder, 637 F.3d 1025, 1028 (9th Cir. 2011). We deny Wachira's petition for review.

Wachira only challenges the agency's determination that she failed to establish that she was a member of her proposed social group. Thus, she has waived any other claims for asylum, withholding of removal, or relief under the Convention Against Torture. See Martinez-Serrano v. INS, 94 F.3d 1256, 1259 (9th Cir. 1996).
Wachira attempted to establish her eligibility for asylum by demonstrating that she had been persecuted on account of her membership in a "particular social group." Ali, 637 F.3d at 1029 (quoting 8 U.S.C. § 1101(a)(42)). For the purposes of this case, we will assume that Wachira's proposed social group of "married Kenyan women who are unable to leave their relationship" is cognizable under the INA. Even so, we find that substantial evidence supports the agency's determination that Wachira failed to establish that she is a member of that social group. Wachira argued was unable to leave her relationship because she feared that her husband would harm her and their children. However, the agency found that although Wachira was not formally divorced, she had been separated from her husband for years. The record also contains evidence that Wachira's children are adults who live apart from her husband and have little to no contact with him. The agency further found that Wachira had the financial means to leave her husband as a result of her successful businesses, and that she was able to travel independently. The record also supports the agency's finding that Wachira had the social means to leave her husband, because she had the support of her family.

The agency assumed that Wachira's proposed particular social group was cognizable under the framework established in Matter of A-R-C-G, 26 I&N Dec. 388 (BIA 2014), which found cognizable the particular social group of "married women in Guatemala who are unable to leave their relationship." Id. at 393. For the purposes of deciding this petition for review, we have no occasion to address or decide whether A-R-C-G erred in finding cognizable the sorts of proposed particular social groups covered by that decision. Cf. Matter of A-B, 27 I&N Dec. 316 (A.G. 2018) (overruling A-R-C-G); Grace v. Whitaker, 344 F. Supp. 3d 96 (D.D.C. 2018) (partially enjoining enforcement of A-B), appeal docketed sub. nom Grace v. Barr, No. 19-5013 (D.C. Cir.); cf. also Gonzales-Veliz v. Barr, 938 F.3d 219 (5th Cir. 2019) (upholding A-B, notwithstanding the Grace injunction).
Wachira cites to Ren v. Holder and argues that if the Immigration Judge had asked more probing questions or elicited additional information, she might have provided additional facts that might have led to a different outcome. Ren clarified the requirements of the REAL ID Act and held that an immigration judge may not require corroborative evidence without giving the applicant notice and opportunity to produce such evidence. 648 F.3d at 1093. Ren does not apply here. The IJ did not need additional corroboration of the facts to which Wachira testified; instead, he credited Wachira's testimony and found that it pointed to a different legal conclusion.

On this record, we cannot say that any reasonable factfinder would be compelled to conclude that Wachira was "unable to leave" her relationship with her husband within the meaning of Matter of A-R-C-G-, 26 I&N Dec. at 393.

She might have hit a rock but I like the way she's still standing. Some ppl get depressed out of stuff but she seems strong. Denial doesn't mean end of life. Some folks were thrown out prematurely but prospered when they got home while others left voluntarily only to return to diaspora.

Our biggest problem is corruption which should be classified as a pandemic, once that's eliminated a lot of issues will leave with it. A lot of politicians are not in the office for us they are there for themselves, however, we are not brave enough to impeach them if they are not serving us. We keep them in the office for 5 years and we reelect them again to do nothing for us, so we are enabling them to do nothing for us. We need to be aggressive and participate in our own rescue let's not expect anyone to come and help us no one is coming this is a self-help program.
