Woman Claims Ownership of Businessman Jimi Wanjigi's Sh56 Million Disputed Land

A woman has moved to court seeking to be enjoined in a case in which tycoon Jimi Wanjigi obtained orders stopping his arrest and prosecution over an alleged conspiracy to commit a felony and forgery of a title deed.

Cissy Kalunde Musembi, who wants to be enjoined in the case as an interested party, claims she is the registered owner of the land and that the parcel has a case before the Land and Environment Court.

She avers that the Directorate of Criminal Investigations (DCI) established that Wanjigi was part of a wider syndicate involved in forgery of land ownership documents.

“There is urgent need for the court to consider the joinder application of the Interested Party/ Applicant before the directions are issued in the matter to allow the court to see through the fraud and theft that was hatched and designed with the aim of fraudulently snatching away from the Interested Party/ Applicant the property known as Land Reference Number 1870/11/200 comprised in grant registered as number IR. No.65800/1," court papers read.

Musembi further claims that Wanjigi procured the restraining orders by misdirecting and withholding material facts from the court in order to protect persons who want to grab her property. The parcel situated in Nairobi’s Westlands area is valued at Sh56 million.

A Nairobi court had on January 18th issued warrants for the arrest of Wanjigi, his wife Irene Nzisa, and their co-conspirators Himanshu Velji Dodhia, Kaneez Noorani, Mohamed Hussein Noorani, Mohamed Hussanali, Kairu Augustine Thuo and John Nyanjua Njenga.

Court documents read that on diverse dates between 9th April 2010 and 5th June 2018 at an unknown place within the Republic of Kenya, jointly with others not before the court, the suspects conspired together to commit a felony namely forgery of a title deed for land registered as IR.65800 LR.N0.1870/11/200 deed plan No.175145 dated 20th July 1993 under the name of Horizon hills limited.
