A group called Victims of Maandamano Insurgents (VMI) has reached out to International Criminal Court (ICC) Prosecutor Karim Khan urging him to investigate opposition leader Raila Odinga and retired president Uhuru Kenyatta for their alleged involvement in recent anti-government protests.
VMI claims that the Azimio Coalition party is responsible for the violent demonstrations that have resulted in loss of life, property damage, and a push to overthrow President William Ruto's government. They accuse Odinga and Kenyatta of committing crimes against humanity which are covered under Article 7 and 8 of the Rome Statute and can be tried by the ICC. The group believes that the protests are not just about the high cost of living as claimed by the Azimio Coalition, but are also related to the 2022 Presidential election in which Odinga lost to Ruto and the Supreme Court confirmed Ruto's victory.
“We are instructed to respectfully draw your attention to grave humanitarian atrocities and war crimes perpetuated against our client, that fall at the heart of your mandate as delineated by the Rome Statute of the International Criminal Court, which confers upon the ICC, unfettered jurisdiction in relation to crimes of international concern, in complementary to national criminal jurisdictions,” the lawyers say in the letter dated July 28, 2023.
The group has requested the International Criminal Court (ICC) to investigate and prosecute anyone involved in recent demonstrations in Kenya. The group claims that opposition politicians have broken the retirement law and are engaging in extremist political actions including incitement and violence against President Ruto's administration. They also allege that underage individuals are being recruited into the "Maandamano Insurgency" and that militia is being used to threaten national security installations.
The group has asked the ICC prosecutor to monitor the situation in Kenya and take action if necessary. In a separate letter, Azimio had asked the ICC to investigate Inspector-General of Police Japhet Koome for declaring opposition protests illegal, which they claim violates the Constitution.

Mhesh Ruto is still Responsible for the safety of all Kenyans. They have given him all the funding, technology, and manpower to adequately deal with the hooligan-demonstrators. When someone comes early in the morning with a truck full of ballast rocks, dumps them on Nairobi expressway, and the truck disappears, then, we have a problem with our security apparatus. We do not need ICC to investigate this. And ICC will not come to Kenya, last time they tried, they ended up with "witnesses" seeking better live abroad.
The ICC court is being run & manipulated by the West, how could thy arrest them if thy do what fit their agenda to undermine African governance & leadership!!
