New Twist in Lawyer Assa Nyakundi Son's Killing Case as Wife Recants Statement Implicating Husband

The case in which Kenyan lawyer Assa Nyakundi is accused of killing his son Joseph Bogonko has taken a new twist.

This comes after his wife Lydia, who was set to testify against the lawyer, recanted her earlier statement implicating her husband.

In court submissions by her lawyers, Mrs. Nyakundi says she has accepted the situation and moved on. She says she wants to reunite with her husband.

Nyakundi shot and killed his youngest son on March 17th under mysterious circumstances. 

While Nyakundi claimed he was holstering his firearm when he accidentally shot his son inside the car, an autopsy report suggested otherwise. The report says Bogonko was shot from outside the car.

His wife and eldest son Noah Nyakuru had been lined up by the prosecution to testify against him.

Nyakundi had been charged with manslaughter but the Director of Public Prosecutions (DPP) withdrew the charges with a view of preferring murder charges against him.

This is after it emerged that detectives assigned to investigate the killing allegedly engaged in a cover-up in order to have Nyakundi face lighter charges.

Mrs. Nyakundi now says she considers the death of her son as an “accident” and wants her husband to be set free since he is "innocent."

“A ground has been given as to what led to the death of our dear son, it was an accident (and) that has been said clearly. The wife has actually admitted that that was an accident (and) she has believed her husband. She has done her own investigations and discovered that it was an accident,” her lawyer says.

This is a big blow to prosecutors, who hoped to use Mrs. Nyakundi and her son's testimony to nail the lawyer.

“What you (prosecution) are doing to Nyakundi is wicked, immoral and completely unacceptable. We cannot destroy a family in this manner. We are destroying Nyakundi’s family, his wife is longing for her husband,” her lawyer John Khaminwa adds.

“No woman in her senses, knowing or having any evidence that her husband is responsible for the death of her son, would want to have him back and share the same roof and bed. No woman would do such a thing. The woman in this particular case wants her husband back; the children want their father back."

Lydia and her son don't want to loose two members of the family out of this one very tragic event. While that may be understandable coming from a person so intimately connected, it's not acceptable because her husband's crime is against him and the republic of Kenya and not the family. They can fogive him as a family and still the state punish him as a matter of law. The government must proof it's case without the benefit of their testimony. As for Khaminwa, it's reckless of you to call prosecutors immoral and wicked for pursuing justice for Bogonko a Kenya citizen who was allegedly murdered in cold blood by his own father. If Nyakundi is innocent and blameless of this crime, why were detectives covering up for him?.

The other day Nyakundi wife said that the father was furious because the deceased son drove his father car without his permission and wrecked it. That was not an accident because the father was furious of what the son had done the day before his death.

Pole sana to the deceased, his blood will not be in vain, mama you will be the next to die accidentally if you truely preventing him from facing justice, they warned you or death threats and now you turning away from the truth, the same gun used with ur son will come to u soon, watch as ur son is not sleeping but watching ur stands. To the father, if its truely accident then u shouldn't lie that u were in the car but serms u were mad with him, only God knows the truth, Alhamdulilahi

Do we have an Overzealous DPP? I think so. He seems to prefer the most serious Charges, before he has considered the Evidence that he has. He charged people with attempted murder, in the fertilizer mercury case, because of an unfounded claim by an MP in Parliament. The Charges have now been dropped, and the fertilizer released into the market, after no evidence of the presence of mercury was produced. He now seems in a hurry to charge the lawyer with murder, without first establishing the relationship between father and son, or the Evidence that he has against him. The rush to charge people, without first investigating a case, will always lead to acquittal, even when a crime has actually been committed, because of lack of evidence.

Nothing in this report indicate that she has recanted her testimony. Though she considers the death an accident. that's her personal conclusion. A good prosecutor can easily combine all the evidence (including her testimony) to prosecute.

Tables should be turned on her and she should be charged with obstruction of justice should she decide to recant her story. They can even stretch it to include conspiracy to commit murder. Who knows maybe she wanted son dead too.

Hizi kesi high profile ama those that draw a lot of public interest in Kenya, huishia hewani. Wale wanajua kukoroga maneno Kortini wanakoroga tu as murderers go scot-free. It becomes a blame game, speculations hapa na pale, then Kenyans get bored and move on to other things. Huyu mwanamke naweza sema ni inferiority complex. Aiseee mwanamke mkisii atakufa na wewe, hata ukiuwa mtoto wake. Allegiance za kiupuzi na vile wanaume wakisii hudharau wanawake wakisii. This Nyakundi guy has to be put down.

Whoever whenever we say recanting the statement. Who has seen this statement? Mwakilishi we hate when we lied to. Why don’t you publish that copy. Don’t like to us.
