MP Peter Kaluma Submits a New Bill to Criminalize Homosexuality in Kenya

Homa Bay Town MP Peter Kaluma has submitted to the National Assembly a new bill seeking to criminalize homosexuality in Kenya.

The Family Protection Bill proposes a ban on homosexuality, same-sex marriages, and all lesbian, gay, bisexual, transgender, and queer (LGBTQ) activities and lobbying in the country. It further recommends clamping down on LGBTQ promoters and funding by various groups.

In his bill, Kaluma argues that sex remains a physical state of being male or female observed and assigned at birth, and not an identity one is free to choose and assign themselves.

He states that parents should retain rights to their children’s education, and they must be informed and give consent to their children's sex education.

The bill also proposes the banning of Comprehensive Sexuality Education (CSE) in pre-primary, primary and secondary school education programs: the teaching of abortion, homosexuality, LGBTQ issues, abortion, and masturbation.

It also seeks to limit the rights to assembly, demonstration, association, expression, belief, privacy, and employment in childcare institutions in respect of homosexual convicts and those engaged in LGBTQ behavior while also prohibiting adoption by homosexuals and LGBTQ persons.

The penalty imposed under the proposed Act ranges from imprisonment of at least 10 years to a death sentence.

The proposed law, Kaluma says, will strengthen the provisions of Article 45 (2) of the Constitution of Kenya, which stipulates that “every adult has the right to marry a person of the opposite sex, based on the free consent of the parties.”

“The proposed law intended to further the provisions of article 45 (2) of the constitution of Kenya and to protect the family will not only consolidate all existing laws relating to unnatural sexual acts but also increase the penalty for those convicted of engaging or promoting the acts to imprisonment for life or commensurate sentence,” he adds.

In 2019, the High Court in Kenya upheld laws criminalizing homosexual acts between consenting adults. Presiding judges Roselyne Aburili, Chacha Mwita, and John Mativo ruled that Section 162 (a) and (c) of Kenya’s Penal Code clearly states that homosexuality is illegal in Kenya.

The court further dismissed claims that the Kenyan LGBTQ community would continue to be stigmatized if homosexuality remained a criminal offense.

“There is no basis upon which the court can say they [LGBTQ community] will be discriminated against. We, [therefore], dismiss the case that they will be discriminated,” said the court. “Stigma is not exclusive to the LGBTQ community. Everyone has the right to access health.”

Iam for strengthening marriages.History has proven that children raised in a house where there is afather,and amother stands abetter change of being well grounded,moraly socially, and... otherwise.However, I dont see how attacking homosexuality strengthens a family unit of man-woman,and child(ren).The following is what would strenghten families:
Good education
Good jobs
Good and affordable healthcare
Good,and affordable housing
Affordable Ugali na kuku,matumbo...etc.
Less or NO mipango ya Kando
Less alcohol consumption...
More of our traditional values that are inline with SCIENCE...
Family men NOT going to prostitutes.

Basically' offer' security in the home,and outside the home. Now tell me how homosexuality saboutages and undermines the aforementioned 'requirements?'

Fair enough,but with studies constanly bearing out that there has always existed at least 10% of homosexuals in very known human society, since man graduated from hunting to farming(staying in one place). The 90% of heteresexuals are enough to create families.Dont you think? As has been the case so far...

@ M Kiraru, you might be on to something here.He has been boondoggling too much on this issue.It's almost like he is fighting his own inner demons by using his public platform.
I still dont understand why homosexuality has captivated some of our so called leaders.Worst,they are not the experts in such matters,they are just driven by emotions,and all kinds of fears.Let's use SCIENCE to understand homosexuality,which has been there since man stood up on his two hind feet.Besides that, we are wasting to much time,and energy talking about a"natural" thing that wont go away.Best to accept and move on.
And for those who think that it might threated human population,consider this- A Tylenol capsule full of sperms is enought to "repopulate" the whole world.One man can produce more than that in seconds...

How about laws that stop corruption, tribalism. Kenya is yet to have a cosmopolitan egalitarian president and National assembly free of ethnicity. Between 1982 and 1999 the life expectancy dropped to 52. Corruption and Tribalism have killed the most number of Kenyans. Today 70% of Kenyans are below 35.

We have very critical, life and death matters in our country adversely impacting more than 1/2 the population in our nation, such as; food security, insecurity, drought, faltering and expensive education system, joblessness, poor healthcare etc! I was arguing with my friend on this topic,and he told me that Kaluma does not have to be an expert to oppose homosexuality.But then what would be his basis for opposing it be then?Just because he is heterosexual,if he is, is that enough...and not biased?
See there is this thing called gender dysphoria that some mistake for homosexuality.My readings tell me that there is avery small percentage of humans who have this dysphoria,and usully the majority out grow it.If Kaluma is concerned that parents in Kenya will start giving their kids hormone suppressant drugs(therapy),then he has apoint.But I hardly think this is what he has in mind.Yes there has been some kind of social contagion in places like USA that has cause kids to want to be different,call for attention,attract sympathy, be a minority or send a social statement,fad...etc.To me this kids have mental issues and they are calling for help.And please do not confuse these with the 10% of homosexuals that have always existed since man walked on two feet; the same homosexuality that is found in other animals.The homosexuality that cannot be explained, is the one I defend.The one people dont chose,or animals chose.
