Kenyan Woman Deported From the US Over Video on Her Phone

A Kenyan woman was deported to Kenya after the US authorities discovered a video of her working in the country despite having a visiting visa. 

On a Brad Show Live episode hosted by lawyer Brad Bernstein on Tuesday, July 11, the victim's sister gave details about her sister's story, saying that she had come to the US with a visitor visa and had gone to Kenya to see her sons before heading back. However, when she arrived, the immigration officers discovered a video on her phone that showed her working, ultimately resulting in her deportation. 

According to the immigration officers, the woman will be barred from entering the US for five years. The lawyer explained that the deported individual has two options: getting married to a US citizen or having parents who live in the US. He added that, given the misrepresentation of her activities in the US, she will not be allowed to reenter the country after her deportation.  

"She can only get a waiver for a green card through a spouse or a parent or she will never get back to America," Bernstein explained. 

Bernstein is the president of the Law Offices of Spar & Bernstein P.C. He is an experienced immigration law expert who has successfully handled over 100,000 cases. According to the US Embassy in Kenya, applying for a visiting visa requires the applicant to have a valid passport, an email address, travel plans, details of their past five trips to the US and other countries, and a digital photo. To renew a visiting visa, a person can go to a US consulate abroad. 

It is worth noting that only people with diplomatic visas and their dependents can renew their visas while in the US. On May 2023, the US Department of State raised the fees for various types of non-immigrant visa applications. They cited that the fee increase was due to the rising cost of inputs.

One of the many reasons why “developing nations” such as the USA, Canada, and many other nations of the EU, are what I call “functioning nations ” is simply that, people are made responsible and accountable for the choices that they make without exceptions.
On the opposite end of the spectrum is what I call, “regressing nations.” In these nations, accountability, and the consequences of one’s actions does not have immediate consequences. In the regressing nations of the world, anything goes: Inefficiency, arrogance, incompetence, bribery, corruption, lies, theft of public property, murder, excessive and insatiable greed is the order of people’s daily lives.
Just remember what happened to the innocent men, women, and children who were burnt alive when they sought shelter in the PCEA church of Kiambaa in Eldoret after the election of 2007: no one has been arresting or brought to trial close to about 16 years ago since then.
I challenge the current sitting president to setup a commission to bring all those who participated in the event to justice before the end ofthis year - 2023.
Israel is still hunting for anyone who participated in their holocaust over 70 years ago. Bring to Justice all the Kiambaa Church closet and silent participants. When? Immediately.

Great insightful commentary that preamble well into what I just read- Mutuku the secretary general of NOCK( nation olympic committee of Kenya) has disclosed that there will be more dopers in Kenya getting banned between now,and the start of 2024 Oympic games.Wow! Talk of prophet of doom !
Kenya barely escaped drastic sanctions from the international regulatory body. As of now,all athletes in Kenya know the evils of doping,and the consequence.So its very disheartening for the secretary general to paint a very bleak picture...I wish,he were wrong.But time and again we have seen our athletes doping,and falsifying documents.
So without a doubt on this score,Kenya is in the "regressing nations" column.Unfortunately we seem to be proud of that. For sports lovers,and those who care for the image of Kenya,it's time to take this dictum seriouly otherwise Kenya might be kicked out of the Olympic games,and other internation events. What ashame that would be...Probably that's what we need to wake up.Is that it?
As I have said before,our athletes could fool and corrupt our local officials,but,it would be very hard to fool the international community as awhole.You dope.You will be caught.Its happening.I dont understand 'the dare devil' mentality of these dopers employ to the detriment of respectable athletes like Faith Kipyegon,Eliud Kipchoge...etc.Kenya is infamously leading the world in doping. And the fall out is not good.Innocent, hardworking,dedicated athletes like the upcoming wonder girl- Mary Moraa are being tarnished for no fault of their own.Some of you will remember Mary Moraa recently dominatedly the highly touted,and advertised Keely Hodgekinson from UK.This prompted her disappointed funs to question the doping season in Kenya.Suggesting that Moraa had evaded testing.So unfortunate.

@ Ndugu Imara-Suluhisho, I have not doubt about yout patriotism,and the love for Kenya,and Africa. You are among many who whip for mother Africa,and wonder why we are where we are despite many years of independence.Ofcourse some will say we just garnered independence "the other day",in a figure of speech. But my respond to that is,What has that go to do with good governance,and doing what is right? Obviously to do what is right we have to elect leaders that do the right thing. How many time in Kenya have we seen questionable character getting plum jobs,or being elected to public offices? Why do we tolerate incompetence,corruption,and shortcuts?
We have laws on the books that would straighten all these mess we see.But is applied selectively.There lies the problem. Another problem is lack of backlash from the public when a public offical is embroiled in malfeasence cases.We seem to look at is as were entertainment.Unfortunately we shall have to endure this mess till the breaking point,them hopefull learn from that and take corrective measures.

Yeap, this is one of the exeptions to the 4th amendement,protection from unreasonable search and seizure.Immigration officials can search your phone.Sure,people have sued,but non has been successful,some cases are pending.

You can be searched. Until you are cleared to enter the US, you are not entitled to anything outside the immigration law. Bill of Rights only apply when you are in the US. That is, cleared at the point of entry and on your way to pick your luggage if you have any. Before then, rights don't apply to you.

Her movements were suspicious. She went to the US on a visitor visa, she went back to Kenya to visit her kids and then returned to the US. That's not normal for a person just visiting. I think they'll just assume you must be working and detain you. Recording a video while working is simple stupidity.

I find myself agreeing with you. The most important thing you can do is raise your children. Her return to Kenya means her children get to grow up around. What if something bad had happened to her children in Kenya while she was chasing $$$? She would not forgive herself. Pesa iko hapo hapo Kenya(thanks Kibaki) no need to chase it majuu

All they need is probable cause, I refused breathalyzer test, they took me to jail, the judge signed off,and they drew blood. I still won the case because I was not drunk, but according to police affidavits, my car smelled like alcohol. Pure BS.

I guess they should have known that small frogs don’t drink alcohol, but not cooperating with the police orders is another story! Police do have awesome powers to make their difficult and dangerous jobs a little easier! I am not saying that there aren’t bad cops, but know your rights as well as the boundaries!
