Court Upholds Sale of Raphael Tuju’s Dari Business Park to Stabex
The High Court has upheld the sale of Dari Business Park in Karen to Stabex International Ltd, while temporarily suspending the auction of Raphael Tuju’s Entim Sidai Wellness Sanctuary under strict conditions.
The court ruled that Tuju’s right to challenge the sale of Dari Business Park expired after the auction concluded in 2024, confirming the transfer of ownership to Stabex, a company co-owned by businessman Jackson Kiplimo Chebett.
Regarding the Entim Sidai Wellness Sanctuary, the court issued a stay of the sale, requiring Tuju to deposit KSh50 million into a joint interest-earning account within 30 days.
Failure to comply will automatically lift the suspension. Tuju is also required to file a formal appeal within 60 days, or the stay will be nullified. The dispute dates back to a 2015 loan Tuju secured from the East Africa Development Bank (EADB), initially reported at KSh2.2 billion, which the lender now claims has grown to around KSh4.5 billion.
The funds were intended to expand his Karen-based businesses, but alleged defaults led to prolonged legal action. In 2019, a UK court recognised the bank’s claim and authorised the seizure of Dari Business Park, a decision later enforced in Kenya.
Earlier this year, Tuju was evicted from the Karen property by auctioneers and security personnel acting on behalf of the new owners. He maintained that he could settle the debt but accused the bank of refusing his offers, opting instead for an auction.
