You Almost Burnt Kenya, Jubilee Party Tells Chief Justice Maraga In a Hard-Hitting Letter

President Kenyatta's Jubilee Party has written to Chief Justice David Maraga to protest what it described as “bias, double standards, impunity and poor leadership” in Kenyan Judiciary.

In a hard-hitting open letter to Maraga, Jubilee Secretary-General Raphael Tuju accused the Chief Justice of “almost burning” the country last year.

“My Lord, with all due respect, may I state the following, not to provoke you but to submit that no powers can be absolute… Irresponsible actions from the Judiciary, Executive or Parliament can burn this country – and with due respect you almost succeeded in burning the country after August 8th Elections,” says Tuju.

Tuju goes further to highlight eight instances where Judiciary exhibited open biasness instead of being being impartial, just and fair.

One of the instances highlighted by Tuju is the perceived refusal by the Judiciary to castigate National Super Alliance's boycott of the October 26th, 2017 fresh presidential election, yet the election was an order issued by the Supreme Court.

"The Supreme Court saw nothing urgent about this petition to the court and gave a hearing date of 27th October 2017. A post de facto date. This was like a naughty wink to NASA to continue with their contempt of the Supreme Court,”  said Tuju.

He further claims that it was open bias for the Apex Court to certify as urgent a case where two petitioners sought to block the October 26th repeat poll, with Maraga directing that the matter be heard the following day, which had been gazetted as a public holiday.

“To any rational observer, it is the kind of fast tracking that you can only get in this country when “you know people,” adds Tuju.

“The case collapsed after some of your Supreme Court judges failed to turn up and you had to eat humble pie”.

He also mentions that Nasa has continued to disregard the court ruling that upheld President Uhuru's victory on October 26th, but the Supreme Court has remained silent even after the opposition went ahead to stage a mock swearing-in ceremony.

“To our consternation, you were quoted by the local media saying that you had no powers to stop your judges from conducting the swearing in of the people’s president… I sincerely hoped that you were misquoted otherwise this would have been another wink to NASA to proceed with their nonsense,” says Tuju.

The Jubilee party boss also questions why Court refused to certify as urgent a case filed by the Attorney General to block the January 30th oath of Odinga and set the hearing for mid February.

He further questions Judiciary's silence on the issue of Nasa's People’s Assemblies, yet a Kitui court suspended the creation of the assemblies.

Tuju’s letter comes barely a week after Maraga accused the Executive of interfering with the independence of the Judiciary, following the recent move by state agencies to ignore court orders.

It is obvious Maraga’s decision was seriously biased in favor of NASA. That is why he nullified Uhuru’s reelection. But if it was never meant to be, it will never be – Raila’s cunningness ate him up when he withdrew from the October 26 contest. Had Raila not withdrawn, Maraga would have attempted to save him by nullifying a second time around. Uhuru should and must replace Maraga in the not distant future.

Justice Maraga SHOULD stay. Tuju has accused him but he’s yet to do a rejoinder. Let’s wait. Or he might not. He’s not a politician after all. All the same, Kenya has consistently lacked real men with 2 balls who can dare go against the grain.....We need 20 Maragas, Matiang’is, Michukis, Mutua’s (Alfred) etc & Kenya will surely fly

@MLACHAKE, I beg to differ. Maraga or shall I say Maraya leant have 2 balls because he is a spineless reptile and a Pharisian hypocrite to be holier than thou. Clearly, Secretary General Tuju has exposed Maraya's totally flawed and weak leadership of the Judiciary. I agree that this coward is not only water boy for Raila but also a useless political malaya for ODM demagogues. I wonder whom this highly incompetent CJ and his equally incompetent DCJ paid corrupt members of JSCfor them to be awarded with these positions which are obviously way above their pay grade. Both of thiese judicial malaya and their counterpart Justice Lenaola must be kicked out SCOK. All three ignorantly think they are above everyone in Kenya, while they are actually acting like fools in fools paradise.

Justice Maraga is what we need in our Judiciary and Kenya in general not opportunists like Tuju. Uhuru and Jubilee has no moral authority to lecture Maraga on how to do his job. Jubilee loses their cases in courts because of their stupidity. Take the example of Miguna's case. There was existing orders for the police to present Miguna to the High Court and the government chose to deport him instead! That was the first mistake and no credible court in the universe can entertain that kind of nonsense. The government has done a poor job in the courts and the internal fights between the former AG and Solicitor general didn't do the government any good. Jubilee needs to put Sheria house in order. The government needs to respect our judiciary. Nobody is above the law, NOBODY!! Way to MARAGA!!!
