Supreme Court Upholds Election of Martin Wambora as Embu Governor

The Supreme Court has on Wednesday upheld the election of Martin Wambora as Embu Governor.

In their ruling, the Judges have dismissed a petition filed by Lenny Kivuti for lack of merit and have declared that Wambora was validly elected.

“No basis upon which to interfere with the Court of Appeal decision,” reads the ruling.

Kivuti moved to the Supreme Court after the Court of Appeal overturned a High Court decision that nullified Wambora’s 2017 election.

In its ruling, the Appeals Court said that the lower court erred in law by nullifying the election of Wambora.

“He dealt with issues that had not been raised before him,” Appeals Court Justice Fatuma Sichale said in her ruling in August 2018.

Justice Fatuma also ruled that the minor irregularities witnessed during scrutiny did not warrant invalidation of Wambora's victory.

In the High Court ruling, Justice William Musyoka said he established that the results of the election were not credible and verifiable.

“There is no doubt that the errors affected the final outcome of the election. I have come to the conclusion that there were irregularities and errors during the counting and tallying of votes."

“The results cannot be said to be credible, verifiable and reflecting the will of the people of Embu,” ruled Justice Musyoka.
