Kenyan Files Petition for Removal of Chief Justice David Maraga

The Judicial Service Commission (JSC) has received a petition for the removal of Chief Justice David Maraga from office. 

The petition filed by Timothy Odhiambo seeks to have Maraga dismissed on the grounds of gross misconduct and misbehavior.

The petitioner claims that by publicly attacking President Kenyatta, Maraga breached the Judicial code of conduct and ethics which state that “a judge shall, as far as is reasonable, conduct himself or herself as to minimize the occasion on which it will be necessary for the judge to be disqualified from hearing and deciding cases.”

The conduct also states that “a judge shall exhibit and promote high standards of judicial conduct in order to enhance public confidence in the judiciary, which is fundamental to the maintenance on judicial independence.”

Maraga is also accused of sub judice for commenting on matters that are presently before the court. During a media briefing this week, Maraga accused President Kenyatta of interfering with the judiciary and disregarding court orders in what could create anarchy. 

“The President has persisted in his refusal despite orders in two cases requiring him to swear in those judges within 14 days,” said Maraga in reference to the 41 judges recommended to Uhuru by JSC for appointment.

“It is important to clearly and categorically state that this shortage of judges and the near paralysis of court operations has been caused by the President. The President has persisted in his refusal despite orders in two cases requiring him to swear in those judges within 14 days.” 

But in a rejoinder, Attorney-General Kihara Kariuki castigated Maraga, saying his attacks on the president appeared to be personal.

“These public attacks which have taken a decidedly personal slant are not only a breach of established norms of Government but are also the more puzzling given the direct lines of communication that exists between the Chief Justice and the President,” said Kihara.

Justice Maraga is protected by law he has security of tenure..he has six months to go. So nobody at any point can interfere with his term now. Unfortunately
laws in Kenya are not respected anymore, The law of the jungle has taken over.. Weeping for my Motherland we need to start breathing again right now many things are choked up

Maraga lacks common decency! So it is fair he resigns for humiliating the judiciary! Being protected by tenure does not allow a sitting CJ to disrespect the presidency by failing to follow the necessary protocols when addressing others, let alone the President! This CJ should do us a favor and resign to reinstate the integrity of the judicial system!

Yes! I’m very mad that Maraga just got two Mercedes 600s ( one for going shopping and one for the evening joy riding) and on top of that expense loaded on poor tax payers, he is demanding 41 more thieves hired to steal our money. @guest, you must be the real Devil not to be mad about Maraga’s tun-drums and tick sucking mental condition! We are tired of his nonsense! Aren’t you???

Maraga does not see the corruption in the judiciary! He is part and parcel of the current problem gnawing Kenya’s legal system! He has been a disgraceful CJ and lacks the due respect of others, to include the president! It is time for Maraga to resign and allow a capable CJ to be appointed! He has been sleeping on the wheel for a long time. Enough is enough Mr CJ!!

There was nothing CJ could have done beyond that.

He even pointed out that he has been privately trying to reach out to the president but the process has been futile, meanwhile there is a lot of backlog cases in court,
What did expect him to do. A sitting president too can't be taken to court.
Maraga is a Kenyan citizen who must also enjoy freedom of expression and a right to protest peacefully despite being a judge.

Out of the 16457 pending cases by March, how many are resolved by now (mid June)? The 31 judges are idlers in offices. Maraga should have assigned at least 5 cases a day to his pets to clear the backlog by July. This CJ has a personal issue with Our President .dating back to .Illigalities and iregularities

Maraga is complaining while he is sitting pretty doing nothing. This old man does not need to be our CJ! He does not know how to plan and he is a lazy as hell to even do anything! 16,000 cases can easily be wiped out with 2 1/2 months! He talks too much but does too little! Impeach him!

There is no court system in Kenya, and no body can change it. Whoever takes the CJ position slowly joins the corruption bandwagon cause cannot change the entrenched system. Many people have offered to computerize the court system in Kenya but have been pushed away. They rather deal with lost files. What a country. Remember Muthai Kangwe thought he will change people at the ministry head office. He is slowly giving up.

Maraga’s legacy is a travesty of himself! I wonder how he got elected to be the worst Chief Justice of the honorable Republic of Kenya!

Kenya has literally been insulted to have a foolish man for CJ! I hope the new CJ to come will cleanse the judiciary of corruption and other evils before he takes over!

Maraga has no history to judge him fairly - only a damn fool can say that shit!

Maraga is a disaster. He is to only an embarrassment because of his poor communication skills, He is so uncivilized, dealing with him is a waste of time.
He can not communicate with his juniors leave alone the President.
Mental retardation not being ruled out, he has presided the worst Judicially. Most Corrupt, Inept and disappointing its a Den of thieves. adding another 41 is a burden Kenyans cannot afford.
