Chinese Company Ordered to Pay MP Muturi Kigano Sh10 Million over Thika Road Accident

The court has awarded Kangema MP Muturi Kigano Sh10 million in compensation over an accident that happened along Thika Road nine years ago.

High Court Justice Joseph Sergon directed Chinese company, Shegli Engineering Construction Group Ltd to pay Kigano the amount after finding out that it failed to care for users during the construction of Thika Road.

Kigano will receive Sh2 million in special damages and Sh8 million for suffering. He suffered scalp injuries, a fractured skull, and sensorineural hearing loss during the March 8th, 2011 accident.

“If the defendant left, the duty of care was solely on the part of the employer (Ministry of Roads), It would have as well taken out third-party proceedings, but the defendant failed to do so,” Justice Joseph Sergon ruled.

On that day, Kigano was driving a Toyota Lexus when he found the road blocked without warning signs. He abruptly braked and hit heaps of murram and concrete barricade causing the car to roll several times near Juja.

He was rescued by well-wishers and rushed to a clinic within Jomo Kenyatta University of Agriculture and Technology (JKUAT).
