Student Who Killed 10 Girls in Dorm Fire at Moi Girls School Nairobi Imprisoned for Five Years

A former Moi Girls School Nairobi student who started the fire that killed 10 girls at the school has been sentenced to five years in prison. This is after she was found guilty of manslaughter in the fire incident that occurred on the night of September 1st/2nd 2017.

Trial judge Stella Mutuku in December last year acquitted the girl of the offense of murder in all the 10 counts and ruled that the offense proved beyond a reasonable doubt was that of manslaughter. She ruled that the prosecution did not prove any malicious intent on the part of the girl who was 14 years old at the time of the incident.

On Thursday, Justice Mutuku sentenced the 18-year-old girl to five years for each of the 10 counts of manslaughter but the sentences will run concurrently. The judge declined to impose a non-custodial sentence on the convict, arguing that the offense of manslaughter is a serious one and calls for a custodial sentence

Justice Mutuku said she arrived at the decision since the accused committed the offense when she was a minor, adding that she was guided by the law and authorities from the Court of Appeal and probation report. She observed that parents of the victims lost their children who were young and their lives will never be the same again.

The sentence will run from December 16th, 2021 when she was convicted of manslaughter.

The court heard that the convict tried to commit suicide more than twice before she resorted to setting a dormitory on fire. Investigations established that the student had unsuccessfully attempted to take her life by swallowing a detergent.

The fire started from her cubicle before it quickly spread to adjacent ones and eventually razed the entire dormitory housing more than 300 Form One students.

5 years only? Am not a lawyer, or educated at all but 5 years really? Was this from court of law or kangaroo court? Anyways kenya imejaa wajinga mpaka hawa judges na lawyers hawajui kusoma anything waliamka tu asubuhi moja wakasema 5 years. Poleni familia

@ Mr collusion, there was atime in USA when minors would commit heinous crimes and the only punishment would be to be sent to juvenile detention...
Americans got tire of these unruly young"murderers",and decided that they will be tried as adults,and face adult sentences. They changed the law.
5 years looks like aslap on wrist for what his"kid girl" did.Unfortunately she committed the crime when she was aminor. This law will remain on the books in Kenya till someone decides that it bout time it was changed.

This guy gets 5 years prison term for killing 10 Kenyan school girls in a dorm fire. Another guy robs a China man 30k and gets a life prison term. Gotta love the justice in Kenya. It’s working for the people.

I'm not in the medical profession, but I BELIEVE this girl needs more than just jail time. Professionals should determine what led her to this.
I believe more could have been done, before she lit the fire.

@ Kora Kanini, what you have just said reminds me of acase that is in process right now in USA. I believe this kid is a teenager charged with murder. He is claiming that he reached out to his parents for help,but they just told him to "toughen up".
Yes, the fact that this girl tried to commit suicide says it all.Iam sure all of use over 35 looking back at when we were 18, we realize how immature were.Now couple that with mental issues,and you have a major problem...

Comrade Maxiley,
To your point, we want to BLAME the kids without looking deep inside ourselves as parents and seeing where we have FAILED them.
In these cases, there are no winners, all FAMILIES lose.
As parents, we need to START spending more time with our children, UNDERSTANDING that, the world of social media, will not help raise them.

Probably you know what you are saying...
If bar exams are conducted like they are in USA, you have to have an ID with a picture, finger prints. What are the chances some one else will be like you,and present these two requirements? Point is its just amatter of time before you get caught.
Lastly you have to atleast have vast knowledge of law to cheat- the way you put it,but still,that is not the same as practicing it...

Had she been forced to be at the school or was this a case of bullying where she felt she had no way out.Now 10 other families are affected by the selfish acts of one coward who eventually never accomplished their mission.Apparently what she did either scared her straight or Kenyan prison guards are very good at their job to ensure she was alive to face the consequences of her actions

This is a sad news to both the victims and her. I can see she has some mental issue or another unsolved issue. Even though she is convicted, she has not received the kind of help she needs to heal the wounds. Thank judge for setting the sentences run concurrently. If she had a good lawyer the sentence would be from whe she was arrested

I can understand the pain of the victims loved ones.May God's peace prevail upon your heart's that you may forgive and heal.The elusive question here is; Does revenge equate to justice? If the girl would have been put into prison for life or even killed for causing the death of the 10 girls, would the treatment accorded to her suffice the 10 lives lost? Moral of judgement is,the world's justice system has limited possibilities.The true justice can only be served spiritually.

Only at 14 when she did it dont deserve jail myt not av intended for that to happen teachers need to learn to talk n listen to students not bully students,even a year bhind bars be too much.did they prove intent
