Wavinya Ndeti Files Petition against Alfred Mutua's Machakos Governor Win

Former Kathiani Member of Parliament Wavinya Ndeti, who contested for Machakos governor seat on a Wiper ticket in the August 8th elections has filed a petition at the high court challenging Machakos Governor Alfred Mutua's win.

Accompanied by her lawyers, Ndeti arrived at the Machakos Law Courts registry on Tuesday evening, where she filed her 10,000-page affidavit seeking nullification of Mutua's victory.

The former MP said that she was in possession of documents that contain enough evidence that the Machakos gubernatorial election was flawed and that the Independent Electoral and Boundaries Commission (IEBC) irregularly declared Mutua the winner.

Mutua, who contested on a Maendeleo Chap Chap party was declared the winner of the race after garnering 249,954 votes against Ndeti's 209,233.

Ndeti claims that Alfred Mutua's victory was preceded by massive irregularities and massive rigging that also led to failure to sign forms 37A, 37B, and 37C, as required by law.

She also alleges that there were non gazetted polling centres, culminating in the unlawful announcement of Mutua as the winner of the governorship race.

Her lead lawyer Daniel Maanzo said that Ndeti has at least 10 lawyers who will argue her case against Mutua.

"Senior Counsel Otiende Amollo will lead a pack of nine other legal minds that will be representing Wavinya in this case," said Maanzo, who is also the Makueni MP.

"We have water-tight evidence to demonstrate Mutua did not win the election in a free, fair, and transparent manner, as demanded by law," Maazo added.

He revealed Wavinya's petition against Mutua and IEBC was one the most important election petitions by the opposition alliance NASA.

Addressing the media outside the court, Ndeti said she was hopeful that Mutua's win will be overturned.

It is very important for the Kenyan Judiciary to own up to the mistake that it made during the annulment of the Presidential Election.Generally speaking courts all over the world use judicial power to uphold the will of the people.Not to effect legal coups against the will of the people/electorate.Otherwise the Kenyan People and the world at large are going to lose faith in the Kenyan Judiciary.The best case scenario at this point, is for the Kenyan Judiciary starting with the supreme court-and all the way to the lower courts- to change course.And rededicate themselves to using judicial power to affirm the will of the people.

Wake up from reality.The supreme Court made a decision based on evidence.Stop this nonsense of the will of the people.Jubilee lost deal with it.She should not think that all other courts will behave in the same manner.If she argues her case and has substantiating evidence she just might get lucky but as it stands she is grasping on straws quite unpopular in Ukambani.
